Особливості банкрутства суб’єктів господарювання державного сектору економіки України

Abstract

У статті розглянуто законодавчо-нормативні засади механізму банкрутства суб’єктів державного сектору економіки України. Звертається увага на механізми санації підприємства. Проведено аналіз особливостей банкрутства державних підприємств. Розглянуто недоліки та проаналізовано напрями подальших досліджень щодо удосконалення механізмів банкрутства. Оговорюється необхідність пов’язувати інструменти санації та механізми банкрутства зі стра¬тегічними державними інтересами.

В статье рассмотрены законодательно-нормативные основы механизма банкротства субъектов государ¬ственного сектора экономики Украины. Обращается внимание на механизмы санации предприятия. Проведен анализ особенностей банкротства государственных предприятий. Рассмотрены недостатки и проанализированы направления дальнейших исследований по совершенствованию механизмов банкротства. Оговаривается необходимость связывать инструменты санации и механизмы банкротства со стратегическими государственными интересами.

The article deals with the legislative and regulatory framework of the mechanism of bankruptcy of the subjects of the public sector of the Ukrainian economy. As of 2017 in Ukraine there are 3,591 business entities of state ownership, of which 297 (8.3%) are in different stages of bankruptcy, including: at the stage disposal of the property - 111, at the stage of the recovery - 65, at the stage of the conclusion of the settlement agreement - 15, at the stage of liquidation - 106. Attention is drawn to the mechanisms for the recovery of the enterprise. In the presence of signs of bankruptcy, a preventive measure is the implementation of a reorganization before the bankruptcy proceedings. Recovery for state enterprises is carried out at the expense of the State Budget of Ukraine, at the expense of state enterprises and other sources of financing. In order to prevent the bankruptcy of state-owned enterprises, the bail of the Cabinet of Ministers of Ukraine or local self-government bodies may be applied by their authorized institutions. Certain features are the bankruptcy of a state-owned enterprise that has a public or other value or special status (city-forming and especially dangerous). The local government institution may apply to the Commercial Court not to apply the procedure provided for by law to such a subject and to terminate the proceedings in the bankruptcy case. At the same time, guarantees are provided for the fulfillment of all claims of creditors on monetary obligations. The analysis of bankruptcy peculiarities of state enterprises is carried out. The shortcomings are considered and the directions of further research on the improvement of bankruptcy mechanisms are analyzed. The need to link recovery tools and bankruptcy mechanisms to strategic state interests is negotiated.
