Abstract

У статті розглянуто правові аспекти визначення інституту банкрутства в Україні, проведено узагальнення та класифікація його функцій і ролі в сучасній економіці та започатковано формування точки зору подальших досліджень інституту банкрутства з позицій взаємодії економічних та фінансових аспектів.

The threat of a possible bankruptcy stimulates a wide range of businesses to introduce measures to prevent it. Institute of bankruptcy is an important part of the market economy and economic regulatory aims of the state. Currently the financial component in the process of bankruptcy has become dominant, became almost the sole and near the main criterion and purpose of the bankruptcy process. It is necessary to review the practice. Finance should be used as a lever by which the bankruptcy process through the institutions of statehood bankruptcy will put a production of goods priority direction, not financial priority direction.
