Концептуальні засади виконання державного та місцевих бюджетів: правові аспекти

Abstract

У статті розглянуто правові аспекти визначення концептуальних засад виконання Державного бюджету України. Виходячи із визначеної мети, виконання бюджету можна розглядати як досягнення відповідності між фактичними результатами дій зобов’язаних суб’єктів бюджетних правовідносин із бюджетними коштами та встановленими бюджетно-правовими нормами показниками акта про бюджет щодо зарахування, розподілу та перерахування коштів бюджету на визначені напрями фінансування у встановленому обсязі. Виконання бюджетів має будуватися на принципах, які покладені в основу правового регулювання стадії виконання бюджетів. Принципами виконання бюджету є основоположні ідеї, керівні засади здійснення учасниками бюджетного процесу діяльності, спрямованої на виконання бюджету, що характеризують закономірності й особливості змісту цієї стадії. Ними мають бути такі основоположні засади та ідеї, які виражають сутність цієї стадії та головні напрями державної політики в сфері правового регулювання цієї стадії. Вихідними для побудови системи принципів виконання бюджету є принципи бюджетної системи, окремі з яких стосуються і виконання бюджету, зокрема, принцип повноти, обґрунтованості, субсидіарності, цільового використання бюджетних коштів, публічності та прозорості, відповідальності, які мають особливості прояву.

The article deals with the legal aspects of the definition of the conceptual principles of the State budget implementation of Ukraine. Based on the particular purpose, budget implementation can be regarded as the compliance between the actual results of the liable subjects’ actions of the budget relationships with budget funds and established budget-legal norms of the act on entering into account, allocation and funds transferring into the certain directions of the financing in set amount. Budget implementation should be based on the principles laid down in the basis of the legal regulation of the budget implementation stage. The principles of the budget implementation are the fundamental ideas, guiding principles of the budget process participants’ activity aimed at the budget implementation and describing the mechanisms of the content of this stage. They should be the fundamental principles and ideas that express the essence of this stage and the main directions of the state policy in the sphere of legal regulation of this stage. The initial principles of building the system of budget implementation principles are the principles of the budget system, some of them relate to the budget implementation, in particular, the principle of completeness, validity, subsidiarity, targeted use of budget funds, publicity and transparency, accountability, which have their own peculiarities.
