Abstract	Однією із найважливіших функцій держави є охорона громадського порядку та забезпечення безпеки кожного члена суспільства. Ці ідеї знайшли своє втілення у нормах Основного закону: стаття 3 встановлює, що права і свободи людини та їх гарантії визначають зміст і спрямованість діяльності держави, їх утвердження і забезпечення є головним обов’язком держави One of the most important functions of the state is protection public order and security of each member of society. These ideas are embodied in the norms of the Basic Law: Article 3 establishes that human rights and freedoms and their guarantees determine the content and direction of the state's activities, their approval and security is the main responsibility of the state
