Принципи діяльності поліції в Україні та за кордоном

Abstract

Діяльність органів державної влади завжди викликала неабиякий інтерес дослідників. Не є винятком і діяльність органів поліції. Сьогодні особливої актуальності набувають питання, що пов’язані з реалізацією державної політики у сфері внутрішніх справ, що, в свою чергу, покладається на органи Національної поліції України. Враховуючи те, що основу діяльності поліції складають принципи, в даній статті було проведено дослідження принципів діяльності поліції в Україні та за кордоном, а також визначено напрямки їх удосконалення. Законодавство про державну службу визначає наступні принципи: верховенства права; законності; професіоналізму; патріотизму; доброчесності; ефективності; забезпечення рівного доступу до державної служби; політичної неупередженості; прозорості; стабільності. У свою чергу, Закон України «Про Національну поліцію» визначає сім основоположних принципів діяльності поліції: верховенство права, дотримання прав і свобод людини, законність, відкритість та прозорість, політична нейтральність, взаємодія з населенням на засадах партнерства, безперервність. Досліджено досвід Англії, Канади, Німеччини, Угорщини, Болгарії, Франції, Словенії, Грузії. Визначено, що у діяльності поліції різних країн світу простежуються як подібні принципи, так і принципи, що різняться за своє суттю. Наголошено на тому, що непорушним і незмінним залишається пріоритет прав і свобод людини, а також законність і верховенство права. Висловлено думку, що використання досвіду розвинених європейських країн дозволить запобігти законодавчим прогалинам та надасть можливість удосконалити як нормативно-правову базу, так і практичну діяльність працівників державного апарату. На підставі аналізу законодавства зарубіжних країни, запропоновано внести зміни до Закону України «Про Національну поліцію», а саме доповнити розділ ІІ «Принципи діяльності поліції» новими статтями, в яких закріпити наступні принципи діяльності поліції: 1) толерантності; 2) співмірності; 3) здійснення дискретних повноважень; 4) підконтрольності та підзвітності; 5) міжнародного співробітництва. Крім того, задля підсилення ролі принципу неприпустимості дискримінації, наголошено на необхідності закріпити останній на рівні окремої статті Закону України «Про Національну поліцію».

Activity of public authorities always attracted uncommon interest of researchers. Also activity of bodies of police is not an exception. Today the special relevance is acquired by questions which are connected with realization of state policy in the sphere of internal affairs that, in turn, it is necessary on bodies of National police of Ukraine. Considering that the principles are a basis of activity of police, in this article the research of the principles of activity of police in Ukraine and abroad was conducted and also the directions of their improvement are defined. The legislation on public service defines the following principles: rule of law; legality; professionalism; patriotism; respectability; efficiency; ensuring equal access to public service; political impartiality; transparency; stability. In turn, the Law of Ukraine "About National police" defines seven fundamental principles of activity of police: the rule of law, respect for the rights and freedoms of the person, legality, openness and transparency, political neutrality, interaction with the population on the principles of partnership, continuity. Experience of England, Canada, Germany, Hungary, Bulgaria, France, Slovenia, Georgia is investigated. It is certain that in activity of police of the different countries of the world both the similar principles, and the principles which differ for the in an essence are traced. The fact that indestructible and invariable is a priority of the rights and freedoms of the person and also legality and the rule of law is noted. The opinion is expressed that use of experience of the developed European countries will allow to prevent legislative gaps and will give an opportunity to improve both standard and legal base, and practical activities of employees of government. On the basis of the analysis of the legislation of the foreign country, it is offered to make changes to the Law of Ukraine "About National police", namely to supplement the section ІІ "The principles of activity of police" with new articles in which to establish the following principles of activity of police: 1) tolerances; 2) harmonies; 3) implementation of discrete powers; 4) controlling and accountability; 5) international cooperation. Besides, for the sake of strengthening of a role of the principle of inadmissibility of discrimination, it is noted need to fix by the last at the level of the separate article of the Law of Ukraine "About National police".
