Зарубіжний досвід державного контролю за діяльністю органів місцевого самоврядування

Abstract

В умовах реформування місцевого самоврядування і територіальної організації влади в Україні актуалізується питання модернізації ролі органів місцевого самоврядування у публічному управлінні на засадах субсидіарності та децентралізації владних повноважень, що водночас зумовлює необхідність удосконалення правового підґрунтя державної контрольної діяльності у сфері місцевого самоврядування. Стаття присвячена аналізу зарубіжного досвіду нормативного регулювання державного контролю за діяльністю органів і посадових осіб місцевого самоврядування. Проаналізовано положення Європейської хартії місцевого самоврядування, що розкривають специфіку регламентації засад державного контролю за функціонуванням місцевого самоврядування, відображаючи практику європейських країн щодо вирішення досліджуваного питання. Автор зосереджує увагу на основних характеристиках функціонування місцевого самоврядування у Німеччині та Польщі. Охарактеризовано інституційну та системно-структурну організацію місцевого самоврядування у розглядуваних країнах. Наголошується на доцільності запровадження в Україні передбачених законодавством зарубіжних країн форм і методів державного контролю у сфері місцевого самоврядування. Узагальнення позитивного досвіду Польщі та Німеччини, накопиченого у цій сфері, дозволяє визначити пріоритетні напрями подальшого розвитку місцевого самоврядування, зокрема, концептуальну модель державного контролю за місцевим самоврядуванням в Україні. Зроблено висновок, що нині рівень правового регулювання державного контролю у сфері місцевого самоврядування в Україні не відповідає європейським стандартам місцевого самоврядування.

In the context of the reform of local self-government and the territorial organization of power in Ukraine, the issue of modernizing the role of local self-government bodies in public administration on the principles of subsidiarity and decentralization of government powers is being updated, which, at the same time, necessitates the improvement of the legal basis for state control in the field of local self-government. The article is devoted to the analysis of foreign experience of regulatory regulation of state control over the activities of local government bodies and officials. The article analyzes the provisions of the European Charter of Local Self-Government, which reveal the specifics of the regulation of the bases of state control over the functioning of local self-government, reflecting the practice of European countries in solving the issue under investigation. The author focuses on the main characteristics of the functioning of local government in Germany and Poland. The institutional and systemic-structural organization of local self-government in the countries under consideration is described. It is emphasized the expediency of introducing in Ukraine forms and methods of state control in the sphere of local self-government envisaged by the legislation of foreign countries. The synthesis of the positive experience of Poland and Germany, accumulated in this sphere, allows us to determine the priority directions of further development of local self-government, in particular, the conceptual model of state control over local self-government in Ukraine. It is concluded that at present the level of legal regulation of state control in the sphere of local self-government in Ukraine does not correspond to European standards of local self-government.
