Підзвітність і підконтрольність Служби безпеки України як спеціального суб’єкта фінансової системи України

Abstract

Стаття присвячена дослідженню проблемних питань підзвітності та підконтрольності Служби безпеки України як спеціального суб’єкта фінансової системи держави. Зазначено, що відповідно до національного законодавства за діяльністю Служби безпеки України здійснюється президентський, парламентський, громадський та судовий контроль. Зроблено висновок, що громадський контроль за діяльністю Служби безпеки України як такий обмежений, через не покладення на вказану спецслужбу обов’язку інформувати громадян про свою діяльність, а також закритий процес розгляду та аналізу звіту, який подається Службою безпеки України до Верховної Ради України. Автором акцентується увага на тому, що якісний контроль за діяльністю Служби безпеки України можливий лише за умови балансу між всіма видами існуючого на сьогодні контролю за виконанням Службою безпеки України своїх завдань та функцій, зокрема мова йде про усунення звітування Голови Служби безпеки України лише вищим посадовим особам держави. У статті також розглянуто досвід зарубіжних держав у питанні контролю та звітності спецслужб. Зокрема, автором розкрито специфіку такого контролю в Австралії, Аргентині, Бельгії, Великобританії, Голландії, Канаді, Німеччині, Норвегії, США. На підставі чого зроблено ряд важливих висновків, які загалом мають підвищити якість контролю за діяльністю Служби безпеки України як спеціального суб’єкта фінансової системи держави та її звітності за результатами такої діяльності, а відповідно підвищити довіру громадян до цієї спецслужби. Автором запропоновано створити непарламентський комітет з питань контролю за діяльністю спецслужб, якому Голова Служби безпеки України буде подавати звіт, а члени вказаного комітету за результатами аналізу звіту надаватимуть парламенту, Голові Служби безпеки України відповідну інформацію щодо задовільної чи незадовільної діяльності спецслужби, основних недоліків такої діяльності та рекомендацій для її покрашення, а громадськості інформацію про результати розгляду такого звіту, окрім тієї яка містить державну таємницю.

The article is devoted to the research of problematic issues of accountability and control of the Security Service of Ukraine as a special subject of the state financial system. It is noted that in accordance with national legislation, the activity of the Security Service of Ukraine is subject of presidential, parliamentary, civil and judicial control. It is concluded that the public control over the activity of the Security Service of Ukraine is so limited that it is caused by the lack of an obligation on the special service to inform citizens about their activity, as well as the closed process of consideration and analysis of the report submitted by the Security Service of Ukraine to the Verkhovna Rada of Ukraine. The author emphasized the fact that qualitative control over the activity of the Security Service of Ukraine is possible only on condition of balance between all types of current control over the execution by the Security Service of Ukraine its tasks and functions, in particular, it is about eliminating the reporting of the Head of the Security Service of Ukraine to senior officials. The article also examined the experience of foreign states in the issue of control and reporting of special services. In particular, specifics of such control in Australia, Argentina, Belgium, the United Kingdom, Holland, Canada, Germany, Norway, the United States of America are disclosed by the author. On this a number of important conclusions have been made: in general should increase the quality of control over the activity of the Security Service of Ukraine as a special subject of the financial system of the state and its reporting on the results of such activity, and accordingly increase citizens trust in this special service. The author proposed to create a nonparliamentary committee on control over the activity of special services, to which the Head of the Security Service of Ukraine will submit a report, and members of the said committee, on the basis of the analysis of the report, will submit to the Parliament, the Head of the Security Service of Ukraine relevant information on the satisfactory or unsatisfactory performance of the Special Service of Ukraine, the main shortcomings of such activities and recommendations for its improvement, and the public about the results of consideration of such a report, except for that containing state secrets.
