Адміністративно-правові форми діяльності правоохоронних органів, що забезпечують фінансово-економічну безпеку країни

Abstract

Стаття присвячена з’ясуванню сутності й особливостей функціонування електронного декларування осіб, уповноважених на виконання функцій місцевого самоврядування, як форми контролю й елементу боротьби з корупцією. Доведено, що в Україні існує необхідність удосконалення діяльності органів місцевого самоврядування з метою недопущення порушення особистих прав і свобод громадян, знищення конституційних гарантій, втрати довіри до влади в цілому, а також запобігання проявів корупції в них. Здійснено аналіз нормативно-правових актів, які регламентують процедурні аспекти електронного декларування. Охарактеризовано дві моделі регулювання системи електронного декларування, які існують у світі. Встановлено, що для України характерна друга модель регулювання – запобігання незаконному збагаченню, зважаючи на високий індекс сприйняття корупції. Визначено поняття електронного декларування, його суб’єкти. Встановлено перелік посад в органах місцевого самоврядування, а також перелік посад з високим та підвищеним рівнем корупційних ризиків у таких органах. Виокремлено види електронних декларацій (щорічна декларація, декларація перед звільненням, декларація після звільнення, декларація кандидата на посаду). Зазначено, що Національне агентство з питань запобігання корупції проводить повну перевірку декларацій, а також такі види контролю: щодо своєчасності подання; щодо правильності та повноти заповнення; логічний та арифметичний контроль. Проаналізовано зарубіжний досвід функціонування електронного декларування у Словенії, Македонії та Сербії. Зроблено висновок, що антикорупційна політика в органах місцевого самоврядування має забезпечуватися за допомогою дієвої системи електронного декларування, спрямованої на підвищення ефективності діяльності осіб, уповноважених на виконання функцій місцевого самоврядування, усунення корупційних ризиків у їх роботі, а також підвищення їх авторитету.

The article is devoted to the analysis of administrative and legal forms of activity of law enforcement bodies, which provide financial and economic security of the country. It is noted that the correct choice of administrative-legal form will ensure the maximum effectiveness of the activity of law-enforcement bodies in this field. The essence of the notion "form" is found out and it is determined that with the help of it the external expression of the content of certain actions, phenomena and etc. Author proved that the forms of certain activities, including in the field of financial and economic security of the country are based on legal requirements. The concept "administrative-legal form of activity of law-enforcement bodies" is analyzed. The author has formulated his own definition of administrative-legal forms of activity of law-enforcement bodies providing financial and economic security of the country. The approaches of scientists to classification of administrative activity, which is closely connected with administrative-legal forms are considered. It is established that the most widespread approach is that the forms of such activity are divided into legal and non-legal (organizational). Author has analyzed the approaches to the classification of forms of administrative and legal activity of law enforcement bodies in general. It has been determined that the division of such forms into legal and non-legal (organizational), main and additional forms is most frequently carried out. Author has analyzed of the classification of administrative and legal forms of activity of law enforcement bodies depending on the method, purposefulness, content, the form of expression, actions of the individuals of administrative-legal activity, competence and nature of the solution of the range of issues legal content. The specific administrative-legal forms of activity of lawenforcement bodies in the field of ensuring financial and economic security of the country are identified, and they are considered depending on the form of expression, namely legal and non-legal (organizational). The author concluded that there is no definition the concept of "the administrative-legal form of the activity of law-enforcement bodies that provide financial and economic security of the country" in the scientific circles and a unified approach to the classification of such forms. The difference between legal and non-legal forms in the analyzed field is noted.
