Сучасні принципи міжнародного права в ієрархії норм міжнародного, наднаціонального і національного права

Abstract

В статі досліджено місце принципів сучасного міжнародного права в ієрархії норм національного права в рамках проблеми співвідношення джерел міжнародного та внутрішнього права. Єдності у вирішенні цього питання в доктрині як національного, так і міжнародного права не досягнуто. Таким чином, ця розглянута проблема є частиною проблеми взаємодії національних правових систем і міжнародного права з коментарями щодо специфіки норм і принципів міжнародного права.

The article examines the place of the principles of modern international law in the hierarchy of the norms of national law within the framework of the problem of the correlation of the sources of the international and the internal law. Unity in solving this issue in the doctrine of both national and national international law has not been achieved. Thus, this problem is part of the problem interaction of national legal systems and international law with comments on specificity norms and principles of international law.
