Правове регулювання державної допомоги сім’ям з дітьми в Україні

Abstract

Соціально-правові дослідження поняття державної допомоги сім'ям з дітьми важливі як в загальнотеоретичному, так і в практичному плані. Термін «державна допомога сім'ям з дітьми», який визначає необхідність державної підтримки соціально незахищених верств населення, досить широко використовується в юридичній та соціально-науковій літературі. Тому теоретичний аналіз змісту цього поняття, безумовно, є актуальним. Крім загальної теорії, фактором важливості такого дослідження є також поточна ситуація соціально-політичного розвитку в Україні, яка проголосила себе демократичною та соціальною. Оскільки вищою цінністю такої держави є людина, її права та свободи, питання повноцінної реалізації державної допомогисім’ям з дітьми безпосередньо пов'язаний зі створенням умов для гідного життя та соціального захисту безпосередньо. Слід зазначити, що дана політика здійснюється на засадах сучасної міжнародної практики соціального захисту громадян у високорозвинених країнах. Україна, яка оголосила пріоритетним зовнішньополітичним напрямком наблизитися до Європейського Союзу, зобов’язаласяздійснювати політику щодо забезпечення та реалізації прав людини відповідно до європейських стандартів. Серед цих прав входить право на соціальний захист, що особливо важливо в контексті ринкових змін та перетворень.

Socio-legal research on the concept of state assistance to families with children is important both in general theoretical and practical terms. The term "state assistance to families with children", which defines the need for state support of socially vulnerable groups, is widely used in the legal and socio-scientific literature. Therefore, the theoretical analysis of the content of this concept, of course, is relevant. In addition to the general theory, a factor in the importance of such a study is also the current situation of socio-political development in Ukraine, which has declared itself democratic and social. Since the highest value of such a state is the person, his rights and freedoms, the issue of full implementation of state assistance to families with children is directly related to the creation of conditions for a dignified life and social protection directly. It should be noted that this policy is implemented on the basis of modern international practice of social protection of citizens in highly developed countries. Ukraine, which has declared a priority foreign policy approach to the European Union, has committed itself to pursuing a policy of ensuring and realizing human rights in accordance with European standards. These rights include the right to social protection, which is especially important in the context of market changes and transformations.
