Правове регулювання допоміжних репродуктивних технологій в Україні

Abstract

Одним із основних та важливих природних прав людей є репродуктивне право, що може реалізовуватися різними способами, забезпеченими законодавцем. Власне даний вид прав реалізується через батьківство. Проте, на жаль, часто бувають випадки, коли можливості реалізувати дане право перешкоджають медичні причини, а саме безпліддя. Питання безпліддя є актуальним в усьому світі. Завдяки активному технологічному прогресу в сфері медицини лікарі поповнюють свій арсенал засобів лікування безпліддя різними методиками лікування. Такі методики мають назву допоміжні репродуктивні технології та дають можливість реалізувати право на батьківство.

One of the basic and important natural rights of people is the reproductive right, which can be exercised in various ways provided by the legislator. Actually, this type of rights is realized through paternity. However, unfortunately, there are often cases when the possibility of exercising this right is hindered by medical reasons, namely infertility. The issue of infertility is relevant around the world. Due to active technological progress in the field of medicine, doctors are replenishing their arsenal of infertility treatments with various treatments. Such techniques are called assisted reproductive technologies and make it possible to exercise the right to paternity.
