Теоретико-правові засади дослідження відмивання корупційних доходів у медичній сфері

Abstract

Проблеми корупції завжди перебувають у центрі уваги громадськості, особливо якщо вони стосуються основоположних благ і цінностей. Проблеми боротьби з відмиванням корупційних доходів актуальні для всіх сфер управління, в тому числі і управління системою охорони здоров’я. На жаль, доводиться визнати наявність корупції у сфері надання медичної допомоги та медичних послуг. Вона завдає серйозної шкоди репутації всієї сфери охорони здоров’я. Вона дає можливість порушникам уникнути відповідальності за протиправні діяння, що породжує безкарність, внаслідок чого відбувається падіння репутації органів державної влади в цілому. Це породжує таке явище, як правовий нігілізм. Саме цим зумовлюється актуальність вирішення зазначеної проблеми, що стоїть перед суспільством і державою. У статті наводиться аналіз тих дій, які в даний час проводяться, і дається оцінка їх ефективності. Приділено увагу традиційним механізмам мінімізації корупції, запропоновано авторські моделі протидії цьому явищу. Також пропонуються і деякі напрями вдосконалення протидії корупції у сфері охорони здоров’я. У багатьох областях України поширені кримінальні правопорушення корупційної спрямованості в системі охорони здоров’я. У сфері охорони здоров’я поширені такі корупційні кримінальні правопорушення: нецільове використання коштів, що виділяються з бюджету на реалізацію державних програм; отримання або давання хабара, протиправні дії у сфері державних закупівель та обігу недоброякісної лікарської продукції; протиправні дії в платіжних системах; зловживання посадовими повноваженнями тощо. Відомо, що корупційні прояви чинять негативний вплив на розвиток економіки, соціальної інфраструктури, руйнуючи органи державної влади. Problems of corruption always are in the spotlight of public, especially if they touch the fundamental blessing and values. Problems of fight against washing of corruption acuestss actual for all spheres managements, including management of health protection the system. Unfortunately it will be to admit the presence of corruption in the sphere of grant of medicare and medical services. She inflicts serious harm to reputation of all sphere of health protection. She gives an opportunity to the violators to avoid responsibility for illegal acts, that generates impunity in turn, as a result there is falling of reputation of public authorities on the whole, that generates such phenomenon as a result, as legal nihilizm. Actuality of decision of this problem that stands before society and state is exactly stipulated these. To the offered article the analysis of those actions that is presently conducted is driven, and the estimation of their efficiency is given. Paid attention to the traditional mechanisms of minimization of corruption, the authorial models of counteraction to this phenomenon are offered also. Also offered and some directions of perfection of counteraction to the corruption in the sphere of health protection. In many areas of Ukraine criminal offences of corruption orientation are widespread in the system of health protection. In the field of a health protection such corruption criminal offences are widespread: the no-purpose use of money that is distinguished from a budget on realization of the government programs; a receipt or summer residence of bribe, illegal actions is in the field of the public purchasing, and also circulation of poor quality medical products; illegal actions are in the payment systems; abuse of post plenary powers et cetera. Well-known is circumstance that corruption displays render negative influence on development of economy, social infrastructure, destroying public authorities first of all.
