Компетенція старости щодо вирішення питань місцевого значення

Abstract

Довготривалий процес реалізації в Україні реформи місцевого самоврядування та територіальної організації влади обумовлений потребою у формуванні такої системи місцевого самоврядування, яка б вирізнялася ефективністю функціонування, а саме належною якістю надаваних публічних послуг, доступністю громадськості до інформації, участі громадян у процесі прийняття рішень на місцевому рівні тощо. При цьому вкрай важливими аспектами залишаються вираження та втілення у життя інтересів мешканців окремих населених пунктів, що, головним чином, покладається на старосту і пов’язане зі здійсненням ним своєї професійної діяльності. Відтак визначення компетенції старости шляхом конкретизації кола повноважень, встановлення прав та обов’язків, якими наділяється ця посадова особа місцевого самоврядування, є необхідною умовою для з’ясування його ролі у вирішенні питань місцевого значення.

The long-term process of implementing the reform of local self-government and territorial organization of power in Ukraine is due to the need to form such a system of local self-government that would be distinguished by the effectiveness of its functioning, namely the appropriate quality of public services provided, public access to information, participation of citizens in the decision-making process at the local level, etc. . At the same time, extremely important aspects remain the expression and implementation of the interests of the residents of individual settlements, which mainly depends on the headman and is connected with his professional activities. Therefore, determining the competence of the headman by specifying the range of powers, establishing the rights and duties conferred on this official of local self-government is a necessary condition for clarifying his role in solving issues of local importance.
