Правові засади формування та функціонування авторитарного режиму: антиномія лібералізму і тоталітаризму

Abstract

Стаття присвячена проблематиці правових засад формування та функціонування авторитарного режиму в його ліберальному та тоталітарному вимірах. При цьому, оскільки президентська трансформація української республіки таїть у собі небезпеку відновлення авторитарних тенденцій, які проявлялися у минулому нашої держави, дослідження авторитарного режиму має актуальний характер. Отже, метою цього дослідження є правові засади формування та функціонування авторитарного режиму у контексті його взаємодії з лібералізмом і тоталітаризмом. Реалізація зазначеної мети потребує виконання низки наукових завдань. У статті обґрунтовано, що якщо ідея запровадження в Україні президентської республіки викликана певними авторитарними сподіваннями, то слід мати на увазі, що, окрім певного позитивного досвіду запровадження авторитарного режиму, існує й негативний бік подібного кроку. З’ясовано, що, на відміну від демократії, де в основу функціонування держави покладена діяльність інституцій, в умовах авторитаризму істотним чином зростає суб’єктивний чинник. Доведено, що чилійська пінократія (влада А. Піночета) характеризується авторитаризмом у сфері політики і лібералізмом у сфері економіки. Стаття містить висновок про те, що якщо економічний розвиток авторитарної держави може мати успіх як в її ліберальному, так і тоталітарному вимірі, то авторитарний персоналізм може обернутися великими проблемами. Наголошується, що досвід тоталітарного авторитаризму в нацистській Німеччині свідчить, що остання зазнала поразки у II Світовій війні унаслідок помилок А. Гітлера, тоді як досвід ліберального авторитаризму пінократичної Чилі прямо вказує, що авторитарний режим, перш за все, збагатив родину А. Піночета та наближених до нього осіб. При цьому відзначається, що присутність в умовах авторитарного режиму потужного репресивного механізму обернулося порушеннями прав людини. З’ясовано, що в умовах III Рейху політика голокосту набула характеру геноциду, а в Чилі доби правління А. Піночета широкого поширення набули катування та довільне правосуддя. Практична цінність роботи полягає у необхідності створення запобіжників авторитаризму навіть в умовах запровадження на теренах України президентської республіки.

The article is devoted to the problems of the legal foundations of the formation and functioning of an authoritarian regime in its liberal and totalitarian dimensions. At the same time, since the presidential transformation of the Ukrainian republic harbors the danger of the restoration of authoritarian tendencies that were manifested in the past of our state, the study of the authoritarian regime is of an urgent nature. Therefore, the purpose of this study is the legal basis of the formation and functioning of an authoritarian regime in the context of its interaction with liberalism and totalitarianism. The implementation of the specified goal requires the performance of a number of scientific tasks. The article substantiates that if the idea of introducing a presidential republic in Ukraine is caused by certain authoritarian expectations, then it should be borne in mind that, in addition to certain positive experience of introducing an authoritarian regime, there is also a negative side of such a step. It was found that, in contrast to democracy, where the functioning of the state is based on the activity of institutions, the subjective factor significantly increases in the conditions of authoritarianism. It is proved that the Chilean pinocracy (the power of A. Pinochet) is characterized by authoritarianism in the political sphere and liberalism in the economic sphere. The article concludes that if the economic development of an authoritarian state can be successful in both its liberal and totalitarian dimensions, then authoritarian personalism can turn into big problems. It is emphasized that the experience of totalitarian authoritarianism in Nazi Germany shows that the latter was defeated in World War II due to the mistakes of A. Hitler, while the experience of liberal authoritarianism in Pinocratic Chile directly indicates that the authoritarian regime, above all, enriched the family of A. Pinochet and those close to him persons to him. At the same time, it is noted that the presence of a powerful repressive mechanism in the conditions of an authoritarian regime has resulted in human rights violations. It was found that under the conditions of the Third Reich, the policy of the Holocaust took on the character of genocide, and in Chile during the reign of A. Pinochet, torture and arbitrary justice became widespread. The practical value of the work lies in the need to create safeguards against authoritarianism even in the conditions of the introduction of a presidential republic on the territory of Ukraine.
