Роль республіканського глави держави в процесах формування та функціонування оборонно-промислового комплексу: конституційно-правовий вимір

Abstract

Стаття присвячена проблематиці конституційно-правового виміру ролі республіканського глави держави в процесах формування та функціонування оборонно-промислового комплексу. При цьому, питання ролі президента в зазначених процесах становить певний інтерес для вітчизняної юриспруденції, оскільки в сучасному вітчизняному суспільстві знову розпочалися дискусії щодо трансформації змішаної системи республіканського правління в президентську. Отже, метою цього дослідження є роль республіканського глави держави в процесах формування та функціонування оборонно-промислового комплексу, зокрема, її конституційно-правовий вимір. У статті обґрунтовано, що президент США, очолюючи виконавчу владу, та співпрацюючи із законодавчою та судовою гілками, фактично уособлює єдність законодавчої, виконавчої та судової влади США. З’ясовано, що президент США функціонально реалізує повноваження глави держави, навіть будучи інституціонально позбавлений цього права. Доведено, що функціонально обов’язки глави держави в умовах республіки виконують президенти. Стаття містить висновок про те, що в Україні президент також може впливати на процеси формування та функціонування оборонно-промислового комплексу. Наголошується, що з урахуванням того факту, що розвиток озброєння і військової техніки прямо стосується питань оборони та національної безпеки, Президент України опосередковано, через РНБО та Кабінет Міністрів України, може впливати на означений розвиток, тим самим здійснюючи свій вплив на оборонно-промисловий комплекс України. При цьому, визначається, що навіть опосередкований вплив, який він здійснює на цю сферу, дозволяє йому ефективно її розвивати. З’ясовано, що запровадження в Україні президентської системи республіканського правління не має суто негативного аспекту, про що в черговий раз свідчить досвід Сполучених Штатів Америки. Практична цінність роботи полягає у обґрунтуванні заперечення необхідності змін конституційно-правового Президента України убік президентської республіки, оскільки навіть в умовах змішаної системи республіканського правління його роль у процесах формування та функціонування оборонно-промислового комплексу нашої держави є доволі значною.

The article is devoted to the issues of the constitutional and legal dimension of the role of the republican head of state in the processes of formation and functioning of the defense-industrial complex. At the same time, the question of the role of the president in the mentioned processes is of some interest for domestic jurisprudence, since in the modern domestic society, discussions regarding the transformation of the mixed system of republican government into the presidential one has started again. Therefore, the purpose of this study is the role of the republican head of state in the processes of formation and functioning of the defense-industrial complex, in particular, its constitutional and legal dimension. The article substantiates that the president of the United States, heading the executive branch and cooperating with the legislative and judicial branches, actually embodies the unity of the legislative, executive and judicial branches of the United States. It has been found that the US president functionally exercises the powers of the head of state, even if he is institutionally deprived of this right. It has been proven that functionally the duties of the head of state in the conditions of the republic are performed by presidents. The article concludes that in Ukraine the president can also influence the processes of formation and functioning of the defense-industrial complex. It is emphasized that, taking into account the fact that the development of weapons and military equipment is directly related to issues of defense and national security, the President of Ukraine indirectly, through the NSDC and the Cabinet of Ministers of Ukraine, can influence the specified development, thereby exerting his influence on the defense-industrial complex of Ukraine . At the same time, it is determined that even the indirect influence he exerts on this sphere allows him to effectively develop it. It was found that the introduction of the presidential system of republican government in Ukraine does not have a purely negative aspect, which is once again evidenced by the experience of the United States of America. The practical value of the work lies in substantiating the denial of the need to change the constitutional and legal President of Ukraine towards a presidential republic, since even in the conditions of a mixed system of republican government, his role in the processes of formation and functioning of the defense-industrial complex of our country is quite significant.
