Вплив воєнного стану на використання електронних інструментів демократії

Abstract

У статті здійснений аналіз впливу воєнного стану на икористання електронних інструментів демократії. Зазначено, що введення воєнного стану, яке обумовлене повномасштабним вторгненням російської федерації в Україну, створює певні обмеження для громадян, як у контексті громадської участі, так і щодо доступу до публічної інформації. Аналізуються нормативно-правові акти, які прийняті під час дії воєнного стану та дається їх оцінка з позицій їх впливу на взаємодію органів місцевого самоврядування з громадськістю. У роботі наголошується, що важливе місце займають інструменти електронної демократії через які органи місцевого самоврядування можуть взаємодіяти з місцевими жителями. Зокрема важливим інструментом локальної демократії є звернення громадян, які можуть бути подані й в електронній формі. Визначено, що конституційна гарантія на звернення є непорушною та не може бути обмеженою навіть у воєнний чи надзвичайний стан. На прикладі міста Суми аналізується кількість звернень місцевих жителів, які були подані під час дії воєнного стану та їх тематика. Наголошено, що інструментом громадської участі, який все більше набуває популярності як на державному так і на місцевому рівні є електронні петиції. Автор відзначає, що електронні петиції є інструментом, який сприяє розвитку демократії, привертає увагу влади до важливих питань та є засобом для оцінювання підтримки відповідних ідей представниками влади. Визначено, що жителі територіальних громад активно подають петиції і під час дії воєнного стану. Предметом місцевих петиції під час воєнного стану стали питання дерусифікації; патріотичного спрямування; продажу алкоголю; в той же час традиційними залишаються питання благоустрою; транспорту; освіти та ряд інших. У роботі проаналізовано особливості електронних консультацій як інструменту громадської участі. Зазначено, що електронні консультації є формою публічних консультацій, що передбачає, зокрема, оприлюднення проектів актів органів державної влади або питань, що потребують вирішення, для отримання пропозицій та зауважень. Визначено, що одним із перспективних інструментів громадської участі є громадський бюджет, який надає можливість кожному мешканцю ініціювати власні проекти та голосувати за інші важливі проекти, фінансування яких здійснюється за рахунок місцевого бюджету.

The article analyzes the influence of martial law on the use of electronic tools of democracy. It is noted that the introduction of martial law, which is caused by a full-scale invasion of the Russian Federation to Ukraine, creates certain restrictions for citizens, both in the context of public participation and access to public information. The normative legal acts adopted during the martial law are analyzed and their assessment is given from the point of view of their influence on the interaction of local self-government bodies with the public. The work emphasizes that the place is important occupy tools of e-democracy through which local self-government bodies can interact with local residents. In particular, an important tool of local democracy is the appeal of citizens, which can be submitted to in electronic form. It was determined that the constitutional guarantee of appeal is inviolable and cannot be limited even in a state of war or emergency. Using the example of the city of Sumy, the number of appeals submitted by local residents during the martial law and their subject matter is analyzed. It was emphasized that electronic petitions are a tool of public participation that is gaining popularity both at the state and local levels. The author notes that there are electronic petitions a tool that contributes to the development of democracy, draws the attention of the authorities to important issues and is a means for evaluating the support of relevant ideas by representatives of the authorities. It was determined that residents of territorial communities actively submit petitions even during martial law. The subject of local petitions during martial law was the question of de-Russification; patriotic direction; alcohol sales; at the same time, issues of improvement remain traditional; transport; education and a number of others. The paper analyzes the peculiarities of electronic consultations as a tool of public participation. It is noted that electronic consultations are a form of public consultations, which includes, in particular, the publication of draft acts of bodies state authorities or issues that need to be resolved, to receive suggestions and comments. It was determined that one of the promising tools of public participation is the public budget, which provides an opportunity for each resident to initiate their own projects and vote for other important projects, the financing of which is carried out at the expense of the local budget.
