Функції принципів юридичної відповідальності при притягненні іноземців та осіб без громадянства до адміністративної відповідальності

Abstract

Стаття присвячена дослідженню функцій принципів юридичної відповідальності при притягненні іноземців до адміністративної відповідальності. В своїй основі принципи юридичної відповідальності складають цілісну систему, що містить в собі найбільш фундаментальні, закономірні та стійкі зв’язки, на яких базується юридична відповідальність. Їх сутність проявляється в тому, що вони є: а) вихідними засадами та ідеями функціонування і реалізації юридичної відповідальності; б) концептуальними умовами притягнення порушника до відповідальності в) критерієм розвитку та вдосконалення інституту відповідальності; г) основні засади, що мають прямий характер, які використовуються для одноманітного застосування закону. В процесі дослідження автор приходить до висновку, що притягнення іноземців та осіб без громадянства до адміністративної відповідальності дає можливість забезпечити режим правопорядку на території України, що встановлений чинним законодавством. Враховуючи особливості наслідків притягнення іноземців та осіб без громадянства, особливої важливості в цьому процесі набувають принципи юридичної відповідальності. При їх застосуванні, вони виконують ряд функцій, що дає можливість в повній мірі забезпечити всезагальну рівність передбачену Конституцією України. До основних функцій принципів юридичної відповідальності при притягненні іноземців та осіб без громадянства можна віднести системоутворюючу, інтегруючу, стабілізаційну, гносеологічну та гарантійну функції.

The article is devoted to the study of the functions of the principles of legal responsibility when bringing foreigners to administrative responsibility. At its core, the principles of legal responsibility make up a whole system that contains the most fundamental, regular and stable connections on which legal responsibility is based. Their essence is manifested in the fact that they are: a) basic principles and ideas of the functioning and realization of legal responsibility; b) conceptual conditions for bringing the violator to justice c) criteria for the development and improvement of the institution of responsibility; d) basic principles of a direct nature, which are used for the uniform application of the law. In the process of research, the author comes to the conclusion that bringing foreigners and stateless persons to administrative responsibility makes it possible to ensure the regime of law and order on the territory of Ukraine, which is established by the current legislation. Taking into account the peculiarities of the consequences of attracting foreigners and stateless persons, the principles of legal responsibility acquire special importance in this process. When they are applied, they perform a number of functions that make it possible to fully ensure the universal equality provided for by the Constitution of Ukraine. System-forming, integrating, stabilization, epistemological, and guarantee functions can be attributed to the main functions of the principles of legal responsibility when attracting foreigners and stateless persons.
