Право на інклюзивну освіту в умовах пандемії COVID-19

Abstract

Згідно зі статтею 53 Конституції України кожен має право на освіту. Держава забезпечує всім громадянам рівний доступ до освіти. У своєму рішенні від 04.03.2004 р. Конституційний Суд України визначив, що доступність освіти як конституційна гарантія реалізації права на освіту на принципах рівності означає, що нікому не може бути відмовлено у праві на освіту, і держава має створити можливості для реалізації цього права . У зв’язку з пандемією COVID-2019 в Україні був запроваджений карантин, який вніс певні особливості в реалізацію права на освіту та організацію освітнього процесу.

According to Article 53 of the Constitution of Ukraine, everyone has the right to education. ensures equal access to education for all citizens. In its decision dated 03.04.2004, the Constitutional Court of Ukraine determined that the availability of education as a constitutional guarantee of the realization of the right to education on the principles of equality means that no one can be denied the right to education, and the state must create opportunities for the realization of this right. In connection with the COVID-2019 pandemic, a quarantine was introduced in Ukraine, which brought certain peculiarities to the realization of the right to education and the organization of the educational process.
