Імплементація міжнародних правил поштового зв'язку та правового доробку ЄС у законодавство та правозастосовну практику України

Abstract

Поштовий зв'язок — це одна з галузей, де необхідно адаптувати внутрішні закони до вимог ЄС. В поштовій галузі існують міжнародні стандарти та правила, встановлені Універсальним Поштовим Союзом. Важливо забезпечити їх ефективну імплементацію в національне законодавство для забезпечення якості та ефективності поштових послуг. Імплементація міжнародних правил поштового зв'язку та законодавства ЄС може сприяти забезпеченню правової безпеки для користувачів поштових послуг в Україні та підвищити рівень їх захисту від шахраїв та недобросовісних операторів. Адаптація законодавства до стандартів ЄС може також сприяти підвищенню конкурентоспроможності українських поштових операторів на міжнародному ринку. Мета роботи – аналіз процесу імплементації міжнародних правил поштового зв'язку та правового доробку Європейського Союзу в законодавство та правозастосовну практику України. Об’єктом дослідження є законодавство та правозастосовну практику України. Предметом дослідження імплементація міжнародних правил поштового зв'язку та правового доробку ЄС у законодавство та правозастосовну практику України. Основними результатами роботи стало дослідження поняття та основних принципів міжнародного права поштового зв'язку, вивчення ролі міжнародних договорів як джерела національного права в контексті поштового зв'язку, аналіз процесу імплементації acquis Європейського Союзу у національне законодавство України, розгляд законодавчих актів України, що регулюють поштовий зв'язок, оцінка правозастосовної практики у сфері поштового зв'язку в Україні та її відповідність міжнародним стандартам, обгрунтування гармонізації законодавства України як передумови членства в Європейському Союзі та виявлення прогресу і перспектив цього процесу, визначення сучасних викликів та перспектив розвитку системи поштового зв'язку в Україні.

Postal communication is one of the industries where it is necessary to adapt domestic laws to EU requirements. In the postal industry, there are international standards and regulations established by the Universal Postal Union. It is important to ensure their effective implementation in national legislation to ensure the quality and efficiency of postal services. The implementation of international postal rules and EU legislation can help ensure legal security for users of postal services in Ukraine and increase their level of protection against fraudsters and unscrupulous operators. Adaptation of legislation to EU standards can also contribute to increasing the competitiveness of Ukrainian postal operators on the international market. The work aims to find out the analyze the process of implementation of international rules of postal communication and the legal amendment of the European Union into the legislation and law enforcement practice of Ukraine. The research object legislation and law enforcement practice of Ukraine. The subject of the study is implementation of international rules of postal communication and EU legal amendments in the legislation and law enforcement practice of Ukraine. The main results of the work are study of the concept and basic principles of international postal law, study of the role of international treaties as a source of national law in the context of postal communication, analysis of the process of implementation of the acquis of the European Union into the national legislation of Ukraine, consideration of legislative acts of Ukraine regulating postal communication, assessment of law enforcement practice in the field of postal communication in Ukraine and its compliance with international standards, justification of the harmonization of Ukrainian legislation as a prerequisite for membership in the European Union and identification of progress and prospects of this process, identification of modern challenges and prospects for the development of the postal communication system in Ukraine.
