Відшкодування шкоди завданої збройною агресією РФ українським підприємствам

Abstract

Актуальність теми дослідження обумовлена масштабними руйнуваннями та значними матеріальними збитками, завданими українським підприємствам внаслідок повномасштабної збройної агресії Російської Федерації. Основними результатами роботи стало визначення правових механізмів Ради Європи щодо захисту майнових прав та відшкодування збитків, аналіз ролі ЄСПЛ у формуванні практики відшкодування шкоди, дослідження методології оцінки збитків підприємств та європейських стандартів документування. У роботі проаналізовано національну практику стягнення збитків з Російської Федерації, досліджено механізми стягнення заморожених активів РФ через інституції Ради Європи та перспективи створення спеціального компенсаційного механізму. Розроблено рекомендації щодо вдосконалення механізмів відшкодування шкоди підприємствам в рамках системи Ради Європи.

The relevance of the research topic is due to the large-scale destruction and significant material damages caused to Ukrainian enterprises as a result of the full-scale armed aggression of the Russian Federation. The main results of the work include the identification of the Council of Europe's legal mechanisms for the protection of property rights and compensation of damages, analysis of the ECtHR's role in shaping the practice of damage compensation, the study of the methodology for assessing damages to enterprises, and European standards for documentation. The paper analyzes the national practice of recovering damages from the Russian Federation, explores the mechanisms for seizing frozen Russian assets through the institutions of the Council of Europe, and the prospects for creating a special compensation mechanism. Recommendations for improving the mechanisms for compensation of damages to enterprises within the framework of the Council of Europe system have been developed.
