| Description: | This thesis is an independent and completed scientific work presenting the first research of theoretical and practical aspects of cargo transit in straight mixed through service. On the basis of theoretical achievements of academic lawyers of different historical periods and the analysis of the current legislation the author investigates the issues inseparably linked with the transportation processes, their legal status, cargo transit planning as well as the definition of transport agreement being a legal form connected with the cargo transportation. Special emphasis is made on the research of the central agreement among contracts in sphere of delivery of cargoes. Also abidance law analysis central agreement, concluded between transport organizations and redounds to delivery of cargoes in straight mixed through service, and also gives clauses for law definition of conception «central agreement».
The thesis focuses on the elaboration of proposals to improve legal regulation of cargo transit in straight mixed through service. The research resulted of introducing proposals for amendments and addition to the current legislation of Ukraine. Besides, systematization of the legislation that regulates transit in straight mixed through service has been carried out revealing gaps and collisions in this legislation and the ways to eliminate them. Дисертація присвячена вдосконаленню правового регулювання перевезення вантажів у прямому змішаному сполученні. На підставі теоретичних здобутків вчених юристів різних історичних періодів та аналізу чинного законодавства автором досліджуються питання кола учасників перевізного процесу, їх правовий статус, планування процесу перевезення вантажів, визначення поняття договору перевезення вантажів у прямому змішаному сполученні як правової форми господарських зв’язків, пов’язаних із перевезенням вантажів. Особливу увагу в роботі приділено дослідженню правової природи, значення, порядку укладання, змісту вузлової угоди. Значна увага в дисертації приділяється розробці пропозицій щодо удосконалення правового регулювання перевезень вантажів у прямому змішаному сполученні. Результатом дослідження стало внесення пропозицій щодо змін і доповнень до чинного законодавства України, проведення систематизації законодавства, яке регулює перевезення вантажів у прямому змішаному сполученні, виявлення прогалин і колізій в цьому законодавстві та способи їх усунення. |
