Участь третіх осіб у цивільному процесі в Україні та в країнах Європейського Союзу

Abstract

В Україні в цивільному процесі поряд із позивачем та відповідачем можуть приймати участь й інші особи, такі як : представники, заінтересовані особи, треті особи та інші. Участь кожної з даних осіб є доволі важливою та необхідною при розгляді цивільних справ, але питання участі третіх осіб ще не є цілком та повністю вивченим та описаним, саме тому, дана стаття присвячена розгляду цього питання. У cтaттi дocліджується та аналізується учacть тpeтiх ociб у цивiльнoму пpoцeci в Укpaїні тa в кpaїнaх Євpoпeйcькoгo Сoюзу. Детально вивчається та описується поняття «третіх осіб», визначаються їхні види в залежності від ступеню зацікавленості у результаті справи, а також досліджуються особливості кожного з видів третіх осіб. Вивчається та описується відмінність між третіми особамии, які заявляють самостійні вимоги щодо предмета спору та третіми особами, які не заявляють самостійних вимог щодо предмета спору у цивільному процесі, проводиться їх часткове порівняння. Також описується порядок та способи залучення третіх осіб під час розгляду справ в цивільному процесі, визначається їх правове та процесуальне становище, а також права та обов'язки залежно від їхнього cтупeня зaцiкaвлeнocтi в peзультaтi cпpaви. Особлива увага приділяється дослідженню та опису особливостей участі третіх осіб у цивільному процесі в різних країнах Європи та Європейського Союзу, таких як : Франція, Польща, Угорщина, Болгарія та інші, а також проводиться їх порівняння з участю третіх осіб у цивільному процесі в Україні. Дана стаття є доволі конструктивною та обгрунтованою, тому має бути цікавою для студентів, науковців, політиків, а також осіб, які цікавляться даною тематикою.

In Ukraine in civil process along with the plaintiff and the defendant can participate other persons too, such as representatives, stakeholders, third persons and others. The participation of each of these persons is highly important and necessary in civil cases, but the question of the participation of third persons is not fully studied and described yet. That is why this article is devoted to consideration of this issue. The article investigates and analyses the participation of third persons in civil proceedings in Ukraine and in the countries of the European Union. Studied in details and described the concept of "third persons" are identified by their types depending on the degree of interest in the outcome of the case, and examines the features of each of the types of third persons. Studied and described the distinction between third persons who declare independent requirements concerning a subject of dispute by third persons who do not declare independent requirements concerning the subject of dispute in civil proceedings, conducted a partial comparison. Also describes the procedures and methods the involvement of third persons during consideration of cases in civil proceedings, determined by their legal and procedural position and rights and obligations depending on their degree of interest in the outcome of the case. Special attention is paid to the study and description of the participation of third persons in civil proceedings in the different countries of Europe and the European Union such as France, Poland, Hungary, Bulgaria etc. and compares them with the participation of third persons in civil proceedings in Ukraine. This article is quite constructive and reasonable so have to be very interesting for students, scientists, politicians, and persons interested in this subject.
