Правовий статус Європейського органу з ринків цінних паперів (ESMA)

Abstract

Формування сучасного інтегрованого ринку цінних паперів ЄС виступає однією з пріоритетних завдань Співтовариства. Це питання є досить важливим з огляду на те, що механізм правового регулювання у цій галузі іще знаходиться у процесі формування та не розвинувся до самостійної галузі права як, наприклад, у США або Об’єднаному Королівстві. Розвиток відносин у сфері фінансових послуг та формування належного законодавства, призвело до відповідного створення і системи інституцій ЄС, які отримали назву Європейських фінансових регуляторів (ESA).

Formation of a modern integrated EU securities market is one of the Community's priority tasks. This issue is quite important given the fact that the mechanism of legal regulation in this field is still in the process of formation and has not developed into an independent field of law as, for example, in the USA or the United Kingdom. The development of relations in the field of financial services and the formation of appropriate legislation led to the corresponding creation of the system of EU institutions, which were named the European Financial Regulators (ESA).
