Правова природа доменних імен в мережі інтернет

Abstract

У статті проаналізоване доменне ім’я як новітній, з правової точки зору, засіб індивідуалізації суб’єктів підприємницької діяльності у віртуальній мережі Інтернет. Досліджено правову природу доменних імен. Здійснено аналіз положень законодавства, точок зору вчених щодо охорони доменного імені та визнання його окремим об’єктом права інтелектуальної власності. Розкрито, що доменні імена в мережі Інтернет є засобами адресації і в такій якості є об’єктами цивільного обігу. Досліджено поняття та функції доменного імені, його правову природу.The article analyzes the domain name as the latest, from a legal point of view, means of individualization of business entities in the virtual Internet. The legal nature of domain names is investigated. The analysis of the provisions of the legislation and views of scientists concerning the protection of the domain name and its recognition as a separate object of the intellectual property right is carried out. It is disclosed that Internet domain names are means of addressing in this network and in this quality are already objects of civilian circulation. The concept and functions of the domain name, its legal nature are investigated.
