Item Administrative and legal principles of activity of ip-court: foreign experience and implementation in Ukraine(Allied Business Academies, 2021) Рєзнік, Олег Миколайович; Резник, Олег Николаевич; Rieznik, Oleh Mykolaiovych; Fomenko, A.; Mykolenko, O.; Денисенко, Сергій Іванович; Денисенко, Сергей Иванович; Denysenko, Serhii Ivanovych; Kibets-Pashutina, D.The authors identify the legal framework and features of the functioning of IP courts in some foreign countries, in particular, in Germany, Austria, Great Britain, Sweden, and Poland. It has been established that, in most states, specialized courts have been established to resolve intellectual property disputes, ie IP courts (in some countries - the Intellectual Property Court, in others - the Patent Court). It has been found that proceedings in this category of cases in many countries are usually carried out in accordance with the rules of civil procedure, ie in accordance with the rules of civil procedure, while in Ukraine proceedings in intellectual property are governed by the rules of commercial procedure. The preconditions for the establishment of an IP court in Ukraine are highlighted. Normative documents of the current Ukrainian legislation are determined, the provisions of which enshrine the administrative and legal principles of the Intellectual Property High Court. They have been posited as widely shared and deeply rooted normative orientations and thus the true foundations of the common European house. This step was probably meant to tap a new source of legitimacy and stability.Item Staffing of Courts: European Experience and the Current Situation in Ukraine(Allied Business Academies, 2020) Kolomiets, T.; Денисенко, Сергій Іванович; Денисенко, Сергей Иванович; Denysenko, Serhii Ivanovych; Korzh, I.; Basai, N.; Fomenko, A.The authors have investigated the current state of staffing of courts in Ukraine and the features of European experience in resolving this issue. Based on the analysis of the provisions of the European Charter on the statute for judges and Recommendation CM/Rec (2010) 12 on judges: independence, efficiency and responsibilities, general and distinctive features have been identified for regulating the staffing of courts, in particular, the issues of selecting judicial candidates, career growth, incentives, advanced training, and the like. The content of the norms of the current Ukrainian legislation, which regulates personnel issues in the formation of the judiciary, is disclosed. The essence of the judicial reform stipulated by the Strategy is determined sustainable development “Ukraine - 2020.” Particular attention is paid to the special training of judicial candidates in the formation of the judiciary in Ukraine, as well as the characterization of existing models of such training in European countries. The article defines a set of issues that have an important impact on quality indicators of staffing of courts.
