Опікунські установи і опікунське право в українських землях (ХІ-ХІХ ст.)

Abstract

У статті йдеться про розвиток опікунської права і опікунських установ в українських землях. Норми давньоримського і візантійського права через християнство стали джерелом опікунського права в Київській Русі. Магдебурзьке і Любецьке міське право вплинуло на литовське право, норми якого діяли в українських землях, особливо ІІ Литовський (Волинський) статут. Ці норми вплинули на козацьке право і на створення першої української опікунської установи - Терехтемирівського шпиталю на території Київського воєводства.

В статье речь идет о развитии опекунского права и опекунских учреждений в украинских землях. Нормы древнеримского и византийского права через христианство стали источником опекунского права в Киевской Руси. Магдебурское и Любекское городское право оказало влияние на литовское право, нормы которого действовали в украинских землях, особенно ІІ Литовский (Волынский) уставы. Эти нормы оказали влияние на козацкое право и на создание первого украинского опекунского учреждения - Терехтомировского госпиталя на територии Киевского воеводства.

The article focuses on the development of guardianship rights and custodial institutions in the Ukrainian lands. Standards of Roman and Byzantine law after Christianity became the source of guardianship law of Kievan Rus. Magdeburg and Lubensk city rights had an impact on the Lithuanian law, which rules operate in the Ukrainian lands, especially II Lithuanian (Volyn) statutes. These standards have influenced the Cossack and the right to build the first Ukrainian institution of trustees - Terehtomirovskogo hospital on the territory of the Kyiv province. In Russia, the tutelary rights standards somewhat different from the European, and therefore Lithuania, the first custodial institution appeared later. Entering the Ukrainian lands under Russian protectorate in the second half of the 17th century, the liquidation of Ukrainian autonomy led to the fact that the second half of the 17th century, especially after Catherine public administration reform (“Governorate reform of 1775”) set in the Ukrainian lands united guardianship system institutions - the aristocratic urban wards orphaned court, the peasant volost gathering. Russian law displaces Cossack but in some areas civil law (marriage - family and guardianship) Russian lawmakers had to reckon with the Ukrainian traditions, formed by the Lithuanian law. The article contains materials of Sumy District archives (funds of Zemsky Court), which deals with the noble care and urban orphaned court.
