Докази та доказування в цивільному судочинстві

Abstract

Дипломну роботу присвячено визначенню сутності та особливостей доказування в цивільному судочинстві в Україні, формулюванню аргументованих пропозицій та рекомендацій щодо його удосконалення. Аналізуються особливості становлення й розвитку цивільно-процесуального законодавства в Україні, визначаються й характеризуються його поняття та завдання. Розкриваються поняття, особливості, ознаки та види доказів, та їх класифікація в цивільному судочинстві. З’ясовуються поняття та особливості доказування в цивільному судочинстві. Характеризуються елементи та стадії доказування в цивільному судочинстві. Розкриваються існуючі проблеми та шляхи вдосконалення в контексті доказів і доказування у цивільному судочинстві. Окреслено перспективи у законодавчому врегулюванні доказів і доказування. Аналізується стан організаційно-правового забезпечення доказування в цивільному судочинстві в Україні та формулюються напрямки щодо його вдосконалення. Сформульовано конкретні пропозиції щодо внесення змін та доповнень до Цивільно-процесуального кодексу України.

Thesis is devoted to determining the essence and peculiarities of proof in civil legal procedure in Ukraine; formulating well-reasoned offers and recommendations about its improvement. Peculiarities of forming and development of civil procedure legislation in Ukraine are analyzed; its notion and tasks are determined and characterized. The notion, peculiarities, features and kinds of evidence and their classification in civil legal procedure are disclosed. The notion and peculiarities of proof in civil legal procedure are found out. The elements and stages of proof in civil legal procedure are characterized. Existing problems and ways of improvement of it in the context of evidences and proof in civil legal procedure are disclosed. The perspectives in the legislative control of evidenced and proof are described. A state of organizational and legal guaranteeing of proof in civyl legal procedure in Ukraine is analyzed; directions of its improvement are formulated. Concrete offers about some amendments and supplements to the Code of Civyl Procedure of Ukraine are formulated.
