Abstract	Статья посвящена дискуссиям о создании действенной правовой структуры для проникновения иностранных банков в Украину. В ней рассматривается значение корпоративной формы иностранных банков для финансовой стабильности страны и исследуется вопрос, как страны могут защитить местных кредиторов иностранных банков, а также, в более широком контексте, всю финансовую систему от финансовых крахов. С этой целью, в статье критически изучены различные механизмы и инструменты. This article seeks to contribute to the debate on how to devise an appropriate legal framework for foreign bank operations. It considers the implications of the corporate form of foreign bank operations and examines how countries can protect domestic financial systems effectively from the detrimental effects of cross-border failures. To this end, it critically reviews the various mechanisms and tools applied in a number of jurisdictions.
