Захист прав дітей в міжнародному праві

Abstract

Захист прав дітей є важливим інститутом міжнародного права. Дитина є особливим суб‘єктом суспільних відносин. Ця особливість зумовлена фізичною та розумовою незрілістю, нездатністю в повній мірі реалізовувати та захищати свої права. Батьки, які є законними представниками своїх дітей повинні проявляти турботу та захист інтересів дитини, а також нести відповідальність за правопорушення вчинене дитиною, що спричинило майнову шкоду. Але якщо дитина позбавлена батьківського піклування, функції захисту прав дитини покладаються на державу. Суспільство та держави всього світу, через різні механізми повинні гарантувати та захищати права дітей, так як молодому поколінню належить визначна роль у формуванні майбутнього розвитку та життєдіяльності суспільства.

The protection of children's rights is an important institution of international law. The child is a special subject of social relations. This feature is due to physical and mental immaturity, inability to fully exercise and defend their rights. Parents who are legal representatives of their children should exercise care and protection of the interests of the child, as well as be responsible for the offense committed by the child, which caused property damage. But if the child is deprived of parental care, the functions of protecting the rights of the child are vested in the state. Societies and countries around the world, through various mechanisms, must guarantee and protect the rights of children, since the younger generation plays a decisive role in shaping the future development and life of society.
