Позитивні зобов’язання держави щодо права на життя за ЄКПЛ

Abstract

Зрозуміло, що у випадку з захистом прав, свобод та охоронюваних законом інтересів зазначені фактори відіграють особливо важливу роль, оскільки окремі права, свободи та інтереси безпосередньо залежать від ступеню своєї захищеності. Цей постулат, в першу чергу, стосується такого виключного, природного і невід'ємного права кожного як право на життя, необхідність захисту якого завжди виникає в критично небезпечних ситуаціях. Відмінні особливості даного права, полягають, головним чином, в необхідності його миттєвого захисту у випадку посягання і абсолютної неможливості його подальшої компенсації або відновлення в разі його порушення.

It is clear that in the case of the protection of rights, freedoms and interests protected by law, these factors play a particularly important role, since individual rights, freedoms and interests depend directly on the degree of protection. This postulate, first and foremost, concerns such an exclusive, natural and inalienable right of everyone as the right to life, the need for protection of which always arises in critically dangerous situations. The distinguishing features of this right are mainly the need for its immediate protection in the event of an encroachment and the absolute impossibility of its further compensation or restoration in case of its violation.
