Щодо самозахисту цивільних прав

Abstract

На сьогоднішній день з розвитком приватного права можна сказати, що великої актуальності набуває питання самозахисту цивільних прав. Цивільні правовідносини суб’єктів цивільного права регулюються законами тієї країни, в яких вони виникли. Питання захисту цивільних прав регулюються Цивільним кодексом України (далі - ЦКУ) і Конституцією України. У статті 15 ЦКУ зазначається: «Особа має право на самозахист свого цивільного права та права іншої особи від порушень і протиправних посягань». Згідно статті 27 Конституції України «кожен має право захищати своє життя і здоров'я, життя і здоров'я інших людей від протиправних посягань», а отже свої особисті немайнові права також. Самозахист цивільних прав є самостійними діями особи, які спрямовані на недопущення порушень своїх цивільних прав або ж, на зменшення їх наслідків. Важливо відзначити, що самозахист прав повинен здійснюватися без звернень та участі уповноважених органів.

Today, with the development of private law, it can be said that the issue of self-defense of civil rights is gaining great relevance. Civil legal relations of subjects of civil law are regulated by the laws of the country in which they arose. Issues of protection of civil rights are regulated by the Civil Code of Ukraine (hereinafter - CCU) and the Constitution of Ukraine. Article 15 of the CCU states: "A person has the right to self-defense of his civil right and the right of another person from violations and illegal encroachments." According to Article 27 of the Constitution of Ukraine, "everyone has the right to protect his life and health, and the life and health of other people from illegal encroachments", and therefore his personal non-property rights as well. Self-defense of civil rights is an individual's independent actions aimed at preventing violations of their civil rights or at reducing their consequences. It is important to note that self-protection of rights should be carried out without appeals and participation of authorized bodies.
