Забезпечення реалізації права на охорону здоров’я та права на працю як інструментів виходу з коронавірусної кризи через призму євроінтеграції

Abstract

Стаття присвячена дослідженню деяких аспектів забезпечення права на охорону здоров’я та права на працю в умовах пандемії COVID-19. Авторами статті був проведений аналіз нормативно правових актів, прийнятих державою з метою запобігання поширенню на території України гострої респіраторної хвороби COVID-19. В ході даного дослідження встановлено, що права і свободи людини і громадянина не можуть бути обмежені Постановами Кабінету Міністрів України. Доведено, що обмеження прав і свобод людини і гро-мадянина можливе лише у випадках, передбачених Конституцією, а саме в умовах воєнного або надзвичайного стану. У статті наголошується, що обмеження таких базових прав, як: права на працю, права на заборону дискримінації залежно від стану здоров’я, права на охорону здоров’я, в тому числі права на медичну допомогу, права на доступність вакцинації для кожної людини, права на добровільну згоду/відмову від вакцинації, права на інформацію про проведення відповідної медичної процедури, права на медичну таємницю є недопустимим.The article is devoted to the study of some aspects of ensuring the right to health care and the right to work in the context of the COVID-19 pandemic. The authors of the article conducted an analysis of regulatory legal acts adopted by the state in order to prevent the spread of the acute respiratory disease COVID-19 on the territory of Ukraine. In the course of this study, it was established that the rights and freedoms of a person and a citizen cannot be limited by the Resolutions of the Cabinet of Ministers of Ukraine. It has been proven that the restriction of the rights and freedoms of a person and a citizen is possible only in the cases provided for by the Constitution, namely in the conditions of a state of war or a state of emergency. The article emphasizes that the restriction of such basic rights as: the right to work, the right to prohibit discrimination based on the state of health, the right to health care, including the right to medical assistance, the right to the availability of vaccination for every person, the right to voluntary consent/refusal of vaccination, the right to information about the relevant medical procedure, the right to medical secrecy is inadmissible.
