Abstract

Здійснено аналіз норм чинного законодавства з регулювання правовідносин у сфері надання послуг з розподілу електроенергії, а також вивчено наявну судову практику з вирішення спорів, що виникають із договорів про надання послуг з роз поділу електроенергії. Запропоновано внести зміни до Правил роздрібного ринку електричної енергії в аспекті визначення періоду, протягом якого здійснювалося порушення. Важливим питанням у спорах, що виникають із договорів про надання послуг з розподілу електроенергії, визнано доказування факту впливу на засоби комерційного обліку.In order to study some problematic issues in resolving disputes arising in the field of providing electricity distribution services related to violations of the Rules of the Retail Electricity Market, an analysis of the norms of the current legislation regulating this area of legal relations was carried out, and the existing judicial practice on resolving disputes arising from transactions, in particular, agreements on the provision of electricity distribution services was studied. It was found that the relationships that arise during the purchase and sale of electricity between the electricity supplier (suppliers) and the consumer (for their own consumption), as well as their relationships with other participants in the retail electricity market, are regulated by the Rules of the Retail Electricity Market, which also establish an exhaustive list of possible violations by consumers when using such services.
