Правове регулювання міжнародного співробітництва у сфері кримінального судочинства

Abstract

Актуальність теми дослідження зумовлена глобалізацією злочинності, зростанням транснаціональних правопорушень та необхідністю ефективного реагування на них з боку держав. Сучасні виклики, зокрема тероризм, торгівля людьми, відмивання доходів, отриманих злочинним шляхом, та кіберзлочинність, не можуть бути вирішені виключно на національному рівні. Тому активна участь держав у міжнародній правовій взаємодії є необхідною умовою забезпечення належного правосуддя, реалізації принципу невідворотності покарання та захисту прав людини. Метою роботи є комплексне дослідження правового регулювання міжнародного співробітництва у сфері кримінального судочинства. Об’єктом дослідження є суспільні відносини, що виникають у процесі міжнародного співробітництва у сфері кримінального судочинства. Предметом дослідження виступають поняття, сутність та форми міжнародного співробітництва у сфері кримінального судочинства. Основними результатами роботи стало комплексне дослідження теоретичних засад міжнародного співробітництва у сфері кримінального судочинства , основних форм; визначення перспектив розвитку міжнародного співробітництва в кримінальному судочинстві.

The relevance of the research topic is due to the globalization of crime, the growth of transnational offenses and the need for an effective response to them by states. Modern challenges, in particular terrorism, human trafficking, laundering of proceeds from crime, and cybercrime, cannot be resolved exclusively at the national level. Therefore, the active participation of states in international legal cooperation is a necessary condition for ensuring proper justice, implementing the principle of the inevitability of punishment, and protecting human rights.The purpose of the work is a comprehensive study of the legal regulation of international cooperation in the field of criminal justice. The object of the study is social relations that arise in the process of international cooperation in the field of criminal justice. The subject of the study is the concept, essence, and forms of international cooperation in the field of criminal justice.The main results of the work were a comprehensive study of the theoretical foundations of international cooperation in the field of criminal justice, the main forms; determining the prospects for the development of international cooperation in criminal justice.
