Перехідне правосуддя: перспективи для України

Abstract

Кваліфікаційна робота присвячена комплексному дослідженню перехідного правосуддя як сучасного правового механізму подолання наслідків збройних конфліктів і масових порушень прав людини. У першому розділі розкрито теоретичні засади перехідного правосуддя, його ключові елементи, зокрема кримінальне переслідування, репарації, встановлення істини та інституційні реформи. Особливу увагу приділено історичним передумовам формування концепції та її міжнародно-правовому підґрунтю. У другому розділі досліджується право на правду як фундаментальний компонент перехідного правосуддя. Проаналізовано зміст і сутність цього права, його визнання в міжнародному праві, а також імплементацію у практиці міжнародних судових органів і комісій правди. Третій розділ присвячено актуальним викликам і перспективам впровадження перехідного правосуддя в Україні в умовах збройної агресії з боку російської федерації. Розглянуто передумови для застосування механізмів перехідного правосуддя, включно з історичними травмами та сучасними воєнними злочинами. На основі міжнародного досвіду запропоновано рекомендації щодо реалізації національної стратегії перехідного правосуддя, включно зі створенням комісій правди, інституційними реформами та забезпеченням репарацій.

The bachelor’s thesis is devoted to a comprehensive study of transitional justice as a modern legal mechanism for overcoming the consequences of armed conflicts and mass human rights violations. The first chapter presents the theoretical foundations of transitional justice, its key elements such as criminal prosecution, reparations, truth-seeking, and institutional reform. Special attention is paid to the historical development of the concept and its international legal framework. The second chapter examines the right to truth as a fundamental component of transitional justice. It analyzes the nature and content of this right, its recognition in international law, and its implementation through the practice of international judicial bodies and truth commissions. The third chapter focuses on the current challenges and perspectives of transitional justice in Ukraine in the context of Russian armed aggression. It explores the prerequisites for applying transitional justice in Ukraine, including historical traumas and current war crimes. The chapter outlines possible mechanisms for ensuring accountability, restoring justice for victims, and building sustainable peace. Based on international experience, the work offers recommendations for implementing national strategies, including the creation of truth commissions, institutional reforms, and reparations. The thesis summarizes key findings and provides practical recommendations that may be used in Ukraine’s post-conflict recovery and reconciliation process.
