Щодо критеріїв медіабельності спорів у сфері нтелектуальної власності

Abstract

Статтю присвячено з’ясуванню та виділенню основних критеріїв медіабельності спорів, що виникають у сфері інтелектуальної власності. З метою виділення основних критеріїв медіабельності спорів, що можуть виникати у сфері інтелектуальної власності, приділено увагу з’ясуванню в чому полягає сутність поняття медіабельності спорів. Акцентовано, що даний термін у нормативних документах чинного українського законодавства не вживається і не зустрічається. З огляду на неодноразовість виникнення наукового інтересу до вивчення змісту поняття медіабельності спору у юридичній літературі, вивчено деякі наукові джерела, де підіймалися та досліджувалися пов’язані із цим питання.The article is devoted to clarifying and highlighting the main criteria for medialability of disputes arising in the field of intellectual property. In order to highlight the main criteria for medialability of disputes that may arise in the field of intellectual property, attention was paid to clarifying the essence of the concept of medialability of disputes. It is emphasized that this term is not used and is not found in the normative documents of the current Ukrainian legislation. Given the infrequent occurrence of scientific interest in studying the content of the concept of medialability of a dispute in legal literature, some scientific sources were studied where related issues were raised and investigated.
