Право інтелектуальної власності Словацької Республіки та його порівняння із вітчизняним правом інтелектуальної власності

Abstract

Стаття присвячена порівняльному аналізу основних положень щодо інституту права інтелектуальної власності в Україні та Словацькій республіці. Такий вибір був зумовлений науковим стажуванням саме у Словацькій республіці. Було визначено, що право інтелектуальної власності у цій країні необхідно розглядати в контексті поділу на 2 основних інститути: інститут авторського права та суміжних прав і інститут промислової власності. У статті визначені основні строки охорони майнових прав інтелектуальної власності у Словацькій республіці.

Статья посвящена сравнительному анализу основных положений по института интеллектуальной собственности в Украине и Словацкой республике. Такой выбор был обусловлен научной стажировкой именно в Словацкой республике. Было определено, что право интеллектуальной собственности в этой стране необходимо рассматривать в контексте разделения на 2 основных института: институт авторского права и смежных прав и институт промышленной собственности. В статье определены основные сроки охраны имущественных прав интеллектуальной собственности в Словацкой республике.

The constant and active development of technologies leads to the emergence of new intellectual property objects, innovative approaches. In the context of the integration processes taking place in Ukraine, the issue of studying intellectual property rights in EU countries is also relevant in order to implement the rules on its legal regulation in Ukraine. Analyzing the development of intellectual property law, we find that it is in a constant process of development. This is due to the fact that technologies are opening new horizons and opportunities to intellectual property rights. The article is devoted to a comparative analysis of the main provisions regarding the institution of intellectual property law in Ukraine and the Slovak Republic. This choice was due to a scientific internship in the Slovak Republic. It was determined that intellectual property law should be considered in the context of the division into 2 main institutions: the Institute of Copyright and Related Rights and the Institute of Industrial Property. In the Slovak Republic, so-called “non-traditional intellectual property objects” are referred to as industrial property rights. As regards the main terms of protection of property rights for intellectual property objects, it should be noted that they are identical between the two countries compared. The article defines the terms of protection of intellectual property rights in the Slovak Republic. It was defined that intellectual property law is a sufficiently specific area of law both in Ukraine and in the Slovak Republic. This is primarily due to the fact that the industry covers several spheres of regulation at the same time and interacts with other industries. Along with the institute of copyright, regulation also takes place in the area of unfair competition, and interaction is actively manifested with civil law in general and contract law and property law in particular.
