Принципи ювенальної юстиції та захист основоположних прав і свобод неповнолітніх осіб

Abstract

Стаття присвячена висвітленню однієї з найбільш актуальних тем сьогодення – системі ювенальної політики та юстиції зокрема. Доведено сталу необхідність України в запровадженні системи ювенальної юстиції як кроку до розбудови української державності в контексті євроінтеграційних процесів. У статті зазначено, що ювенальна юстиція являє собою злагоджену діяльність системи спеціалізованих державних органів у сфері захисту основоположних прав і свобод неповнолітніх осіб. Авторами аргументовано, що побудова ефективної системи ювенальної юстиції в Україні неможлива без детального вивчення її специфічних ідентифікуючих принципів. Проаналізовано думки окремих науковців щодо визначення сутності ювенальної юстиції як частини ювенальної політики держави, а також її організаційно-правові особливості. У результаті аналізу численних академічних та легальних джерел виокремлено та окреслено основні принципи, що притаманні ювенальній юстиції як самостійному правовому інституту.

The article is devoted to one of today's most relevant topics- the juvenile policy system and justice in particular. In the course of the analysis of a number of sources of statistical information, the constant necessity of Ukraine in the introduction of juvenile justice as a step towards the development of Ukrainian statehood in the context of European integration processes was proved. The article states that juvenile justice is a coordinated activity of the system of specialized state bodies in protecting the fundamental rights and freedoms of minors. The authors argue that building an effective juvenile justice system in Ukraine is impossible without a detailed study of its specific principles. The opinions of some scholars on the definition of specific principles of juvenile justice are analyzed. As a result of the analysis of numerous academic and legal sources, the fundamental principles of juvenile justice have been singled out and outlined, which are inherent exclusively in this legal institution and allow to identify it among other legal institutions. Among the main principles of juvenile justice are the following: security orientation, systemic juvenile justice, strict compliance with the law when working with minors, social saturation, focus on the needs of children and youth, and ensuring their participation in society, innovation, and openness to change minors, the principle of individualization, and a transdisciplinary approach. The paper focuses on the transdisciplinary approach as a way to objectify and ensure diversity in the construction and implementation of juvenile policy. Also, the authors pay attention to the principle of individualization as a way to overcome the uncertainty in the classification of methods of influence on the age of the subject of influence in the implementation of juvenile justice.
