Апроксимація законодавства України до законодавства ЄС у сфері поводження з побутовими відходами

Abstract

Актуальність теми дослідження пов’язана з глобальною проблемою людства – забрудненням, нанесенням шкоди, як людині, так і навколишньому природному середовищу, яке здійснюється через значне збільшення обсягів побутових відходів. Європейський Союз в даному дослідженні виступає прикладом здійснення управління побутовими відходами, проводячи активну політику стандартизації поводження з побутовими відходами та організації їх належного управління, зокрема в рамках досягнення цілей Європейського зеленого курсу. Апроксимація законодавства України до норм ЄС у сфері поводження з побутовими відходами є надзвичайно важливою в умовах євроінтеграції та викликів, що постають перед українською державою на шляху до вступу в Європейський Союз. Окрім того, проблема управління побутовими відходами є надзвичайно актуальною в умовах всебічної екологічної кризи, яка настигає людство, саме тому існує потреба вдосконалення системи контролю, управління та відповідальності в рамках поводження з побутовими відходами. Мета роботи – провести аналіз напрямів апроксимації законодавства України у сфері поводження з побутовими відходами до законодавства ЄС. Об’єктом дослідження є суспільні відносини у сфері управляння побутовими відходами в Україні, напрями апроксимації в означеній сфері. Предметом дослідження є нормативно-правові акти, норми яких регулюють відносини у сфері управління побутовими відходами, законодавство ЄС про відходи. Основними результатами роботи стало комплексне дослідження правового механізму управління побутовими відходами в Європейському Союзі відповідно до цілей Європейського зеленого курсу, виявлення особливостей здійснення такого управління та контролю, а також дослідження механізму управління побутовими відходами в Україні.The relevance of the research topic is related to the global problem of humanity - pollution, harming both people and the surrounding natural environment, which is carried out due to a significant increase in the volume of household waste. In this study, the European Union serves as an example of household waste management, pursuing an active policy of standardizing household waste management and organizing its proper management, in particular within the framework of achieving the goals of the European Green Course. Approximation of Ukrainian legislation to EU norms in the field of household waste management is extremely important in the context of European integration and the challenges facing the Ukrainian state on the way to joining the European Union. In addition, the problem of household waste management is extremely urgent in the conditions of a comprehensive ecological crisis that is catching up with humanity, which is why there is a need to improve the system of control, management and responsibility in the framework of household waste management. The purpose of the work is to investigate the process of legal approximation and to propose recommendations for the successful approximation of Ukraine to EU environmental standards. The object of the study is household waste management in Ukraine in the context of its convergence with EU legislation and practices. The subject of the research is legislative and normative regulation, as well as mechanisms of approximation of Ukrainian laws to EU law in the field of household waste management. The main results of the work were the generalization of the existing mechanism of household waste management in the European Union in accordance with the goals of the European Green Course, the identification of the features of such management and control over it, as well as the study of the national mechanism of household waste management in Ukraine, the problems of such management and ways of solving them by approximation rights to EU law.
