Стандарти Ради Європи у сфері доступу до правосуддя та правової допомоги

Abstract

Актуальність теми. Обгрунтовується тим, що доступ до справедливого судового розгляду та загалом до правосуддя та правової допомоги є ключовою складовою демократії та розвитку суспільства. Стандарти Ради Європи є наднаціональними правовими інструментами, прийнятими з метою забезпечення дотримання прав людини та зміцнення демократії. Вони містять принципи та рекомендації щодо різних аспектів доступу до правосуддя та правової допомоги, включаючи забезпечення доступності та якості правосуддя, розширення доступу до правової допомоги, захист прав людини, принципи професійної етики для адвокатів та інших фахівців з права. Метою дослідження є з’ясувати сутність та зміст стандартів Ради Європи, проблеми їх реалізації в Україні, надати рекомендації стосовно основних напрямків втілення стандартів Ради Європи у сфері доступу до правосуддя та правової допомоги взагалі та в Україні під час воєнного стану. Об'єктом дослідження є функціонування та запровадження стандартів Ради Європи у сфері доступу до правосуддя та правової допомоги. Предметом дослідження є стандарти Ради Європи у сфері доступу до правосуддя та правової допомоги. Основними результатами роботи стали: проведений загальний аналіз стандартів Ради Європи, їх історичний аспект та закріплення на міжнародному та національному законодавчому рівні. Розглянуто теоретичні аспекти понять «доступ до правосуддя» та «правова допомога». Проведено аналіз рішень ЄСПЛ у цій сфері, досліджено проблему обмеженя доступу до правосуддя та правової допомоги в Україні а також визначено основні перспективи та тенденції вдосконалення процесу реалізації європейських стандартів у сфері доступу до правосуддя та правової допомоги в Україні.The relevance of the topic is justified by the fact that access to fair trial and, in general, to justice and legal aid is a key component of democracy and societal development. The Council of Europe standards are supranational legal instruments adopted to ensure respect for human rights and strengthen democracy. They contain principles and recommendations on various aspects of access to justice and legal aid, including ensuring the accessibility and quality of justice, expanding access to legal aid, protecting human rights, and professional ethics principles for lawyers and other legal professionals. The aim of the research is to clarify the essence and content of the Council of Europe standards, identify the problems of their implementation in Ukraine, and provide recommendations regarding the main directions for implementing the Council of Europe standards in the field of access to justice and legal aid in general and in Ukraine during a state of war. The object of the research is the functioning and implementation of the Council of Europe standards in the field of access to justice and legal aid. The subject matter of the research is the Council of Europe standards in the field of access to justice and legal aid. The main results of the work are a general analysis of the Council of Europe standards, their historical aspect, andtheir establishment at the international and national legislative levels. The theoretical aspects of the concepts of "access to justice" and "legal aid" are considered. An analysis of the ECHR's decisions in this field is conducted, the problem of limited access to justice and legal aid in Ukraine is researched, and the main prospects and trends for improving the implementation of European standards in the field of access to justice and legal aid in Ukraine are determined.
