Abstract Як відомо, в правовій науці категорія «глави держави» розкривається через два поняття : «інститут глави держави» та «статус глави держави», які співвідносяться між собою як форма (інститут) та зміст (статус), тобто, інститут глави держави розкривається через його статус. При цьому, конституційно-правовий інститут глави держави дуже тісно пов’язаний із адміністративно-правовим інститутом глави держави. Конституційне право включає правові норми, що закріплюють принципи організації усієї системи органів державної влади, а також конституційні аспекти формування та функціонування глави держави. Норми ж адміністративного права, засновуючись на конституційно-правових принципах, деталізують їх відносно численної системи органів виконавчої влади, регулюють діяльність цих органів з приводу реалізації виконавчо-розпорядчих функцій. За логікою системи юриспруденції та права адміністративно-правовий інститут глави держави, виходячи з предмету адміністративного права, повинен бути пов’язаним із статусом глави держави саме у сфері виконавчої гілки влади.
The category of "head of state" is revealed through two concepts: "the institute of the head of state" and "the status of head of state". They relate to each other as a form (institute) and content (status), that is, the institute of the head of state is revealed through his status. The constitutional and legal institute of the head of state connected with the administrative-legal institute of the head of state. Constitutional law includes legal norms that establish the principles of organization of the whole system of state authorities, as well as constitutional aspects of the formation and functioning of the head of state. The norms of the administrative law, based on the constitutional and legal principles, detail their relatively of system of bodies of executive power, regulate the activities of these bodies on the implementation of executive and regulatory functions. The administrative-legal institute of the head of state, based on the subject of administrative law, should be related to the status of the head of state precisely in the sphere of executive branch of government.
