Історія становлення і розвитку інституту поліцейського

Abstract

У статті досліджено особливості розвитку інституту поліцейського починаючи з його зародження у часи античності. Проаналізовано міркування наукового співтовариства стосовно особливостей розвитку зазначеного інститут у різні періоди історії. На підставі аналізу нормативно-правових актів визначено осіб, які виконували функції поліцейського починаючи з появи поліції за часів царської Росії і закінчуючи прийняттям Закону України «Про Національну поліцію». Крім того, досліджено особливості розвитку інституту поліцейського у період радянської влади, Німецько-радянської війни, входження України до СРСР. У результаті проведеного дослідження виокремлено етапи становлення інституту поліцейського: 1 етап – античні часи (поява перших згадок про поліцію); 2 етап – 18 ст. - період царської Росії (поява поліцейського, який за своїми функціями нагадував сучасного, створення спеціалізованих поліцейських органів на території України); 3 етап – радянський період (функції поліцейського виконували працівники робітничо-селянської міліції; закріплення нових функції у представників міліції у зв’язку з Німецько-радянською війною; реорганізація органів міліції: перетворення Народного комісаріату внутрішніх справ на Міністерство внутрішніх справ СРСР, прийняття Дисциплінарного статуту; ліквідація МВС СРСР; затвердження «Положення про радянську міліцію»; створення МВС УРСР; прийняття Закону УРСР «Про міліцію»); 4 етап – період незалежності України (прийняття Законів України «Про внесення змін і доповнень до Закону Української РСР «Про міліцію», «Про оперативно-розшукову діяльність», «Про пенсійне забезпечення військовослужбовців та осіб начальницького і рядового складу органів внутрішніх справ», Розпорядження Президента України «Про затвердження Положення про Міністерство внутрішніх справ України», Закону України «Про Національну поліцію», Положення про Національну поліцію). Підкреслено, що остаточно статус поліцейського було законодавчо закріплено із прийняттям Закону України «Про Національну поліцію».

In the article it was defined the features of the police officer institution development since its inception in antiquity. It was analyzed the arguments of the scientific community regarding to the features of development of this institute in different periods of history. In the article it was defined persons who performed the functions of the police officer during the royal Russia and ending with the adoption of the Law of Ukraine "On the National Police" based on analysis of normative-legal acts. In addition, there was determined the peculiarities of development of the institution of the police officer in the Soviet period, the German-Soviet war, the entry of Ukraine in the USSR. In the result of the study there were defined the stages of formation of institute of a police officer: stage 1 – ancient times (the first mention of the police officer); stage 2 – the 18th century - the period of royal Russia (the appearance of the police officer who functions like a modern, creation of specialized police agencies on the territory of Ukraine); stage 3 – the Soviet period (functions of the police officer were performed by the employees of the worker-peasant militia; securing the new functions of the police in connection with the German- Soviet war; the reorganization of the police: transformation of the People's Commissariat of Internal Affairs to the Ministry of Internal Affairs of the USSR, the adoption of the Disciplinary Charter; liquidation of the USSR Interior Ministry; approval of "Regulation on the Soviet police"; the creation of the Ministry of Internal Affairs of the USSR; adoption of the law of Ukrainian SSR "On police"); Stage 4 – the period of independence of Ukraine (Laws of Ukraine "On introducing amendments and addenda to the Law of Ukrainian SSR "On police", "On operative-search activity", "On pensions of military personnel and persons of commanding and ordinary structure of law-enforcement bodies", the Decree of the President of Ukraine "On approval of the Regulations on the Ministry of Internal Affairs of Ukraine", law of Ukraine "On the National police", Regulations on the National police). There was underlined that the final status of the police officer has been enshrined in law with the adoption of the law of Ukraine "On the National police."
