Наукові положення ідентифікації людини за ознаками зовнішності

Abstract

Стаття присвячена аналізу криміналістичних положень відносно висунення та перевірки версій. У публікації вказується, що висунення та перевірка криміналістичних версій – це розумова діяльність слідчого або іншої уповноваженої законом особи з метою побудови певного судження відносно події злочину. Наведено у статті інформаційну основу, яка охоплює фактичну та теоретичну базу інформації відносно вчиненого злочину. Вказано підстави для висунення криміналістичних версій, а також наведено правила, якими мають користуватися суб’єкти пізнавальної діяльності під час висунення версій. Також наведено та охарактеризовано прийоми логічного мислення, які застосовуються під час побудови (висунення) версій, а саме: аналізу та синтезу, індукції, дедукції та аналогії. За допомогою цих прийомів, більш інформативно будуються версії. Після висунення версій проводяться певні дії, які спрямовані на збирання та перевірку доказів. Відносно перевірки криміналістичних версій у статті вказується, що цей процес проводиться з метою встановлення істини у справі. Процес перевірки включає в себе паралельну перевірку усіх висунутих версій, для того щоб з усіх наявних та ймовірних версій виділити лише одну, яка має пряме відношення до справи. Під час побудови та перевірки версій використовуються знання про криміналістичну структуру злочину, це дозволяє систематизувати фактичну основу версії, простежити зв’язок між елементами злочину. У висновках закріплено положення, що слідчі версії мають велике практичне значення і є обов'язковим елементом в розкритті та розслідуванні злочинів.

The article is devoted to the analysis of scientific positions of human identification on the basis of appearance. The publication states that gabitioscopy (gabitiology) is used for the detection and identification of the perpetrator. The concept of forensic gabioscopy (gabitology) is presented as an important part of forensic technology. The article of gabitoscopy (gabitiology), which is the appearance of a person, is given. Also, the methods used when identifying a person are indicated. In the article, characterized properties used for identification (individuality, relative stability and reflexivity), it is also indicated that these properties of external attributes allow a reliable and comprehensive identification of a person. Characteristics of human appearance are described and described. Their classification is given, as well as which features are used more often to identify the person, and which are secondary features, but which in certain cases can help in this process. Specifies the rules by which a description of appearance is made. As part of the exploration, the necessity of joint use of gabitoscopy (gabitology) in the investigation and prevention of crimes by law enforcement agencies has been analyzed and revealed. The conclusions state that gabitioscopy (gabitiology) uses and combines the modern achievements of many sciences – anatomy, anthropology, psychology, physiology. Although it uses the achievements of other sciences, but as a branch of forensic technology does not cease to develop. After analyzing recent research, the results and achievements in the field of forensic gabioscopy (gabitology) provide unlimited possibilities for solving forensic problems in the process of investigation and disclosure of crimes.
