Історичні аспекти становлення та діяльності митних постів на території України

Abstract

Стаття присвячена науковому дослідженню основних періодів становлення і діяльності митних постів на території України. Автором звернено увагу на те, що стягнення митних платежів було відомо ще за часів існування Київської Русі. Особливу увагу у статті приділено митним зборам і митним установам Запорізької Січі, яка передбачала досить розгалужений апарат управління митною сферою. Зазначається, що за часів входження українських земель до складу Російської імперії відбулося утворення нових митних органів: митниць 1, 2 та 3 класу, а також митних застав та митних переходів. Автор наголошує на тому, що після Жовтневої революція управління митною справою стало функцією центральної влади, митниці діяли в інтересах суспільства, а їх діяльність мала бути відкритою і зрозумілою. Розглянуто також особливості митних установ 1920-1928 рр., зокрема те, що на території України в цей час діяло 44 прикордонні митні установи, які поділялись на митниці, митні нагляді та митні пости. Аналіз історії становлення та діяльності митних установ на території України дозволив автору зробити висновок, що сформовано у 30-х рр. система митних установ з несуттєвими змінами проіснувала до 1964 року, коли було прийнято новий Митний кодекс СРСР та реформовано існуючі митні установи. З’ясовано, що становлення митних установ з проголошенням незалежності Україною у 1991 році розпочалося з прийняття ряду нормативно-правових актів з метою ефективного управління митною сферою держави та створення Державного митного комітету, який згодом було перейменовано у Державну митну службу України. На підставі проведеного наукового дослідження автором запропоновано виділяти п’ять періодів становлення та діяльності митних органів на території України. Останній з яких розпочався у 1991 році, коли Україна набула статусу самостійного учасника економічних відносин на міжнародній арені та триває до сьогодні. Серед особливостей цього періоду звернено увагу на те, що митні пости загалом входять до структури органів Державної фіскальної служби України, які є результатом об’єднання податкової та митної служб держави.

The article is devoted to scientific research of the main periods of formation and activity of customs posts on the territory of Ukraine. The author draws attention to the fact that the collection of customs payments was known at the time of the existence of Kievan Rus. Particular attention is paid to customs duties and customs institutions of the Zaporizhzhya Sich, which envisaged a fairly branched control of the customs sphere. It is noted that during the time of the entry of Ukrainian lands into the Russian Empire, new customs bodies were formed: customs 1, 2 and 3 classes, as well as customs bonds and customs transits. The author emphasizes that after the October Revolution, the management of the customs sphere became a function of central government, the customs operated in the interests of society, and their activities should be open and understandable. The peculiarities of customs establishments of 1920-1928 were also considered, in particular, that at the time there were 44 border customs establishments on the territory of Ukraine, which were divided into customs, customs inspections and customs posts. The analysis of the history of the formation and operation of customs institutions on the territory of Ukraine allowed the author to conclude that the system of customs institutions formed in the 1930's with insignificant changes lasted until 1964, when the new Customs Code of the USSR was adopted and the existing customs institutions were reformed. It was clarified that the formation of customs authorities with the proclamation of Ukraine's independence in 1991 began with the adoption of a number of legal acts aimed at the effective management of the customs sphere of the state and the creation of the State Customs Committee, which was later renamed the State Customs Service of Ukraine. On the basis of the research carried out by the author, it is proposed to allocate five periods of formation and activity of the customs authorities on the territory of Ukraine. The last one began in 1991, when Ukraine became an independent participant of economic relations in the international level and continues to this day. Among the features of this period, attention was drawn to the fact that customs posts are part of the structure of the agencies of the State fiscal service of Ukraine, which are the result of the unification of the tax and customs services of the state.
