Cучасний стан та перспективи державного регулювання за платіжними системами в Україні

Abstract

Стабільний розвиток економіки та фінансової системи є одним із пріоритетних напрямків діяльності кожної країни. Перехід незалежної України на ринкову економіку та появу грошово- кредитних відносин зумовлює розширення масштабів здійснення нею фінансової діяльності, яка виникає з приводу формування, розподілу та використання централізованих та децентралізованих фондів грошових коштів, що зумовлює потребу в контролі за вказаними процесами та необхідність їх правового регулювання. Стаття присвячена дослідженню поняття та оособливостей контрольно-фінансових правовідносин в Україні. Вперше було встановлено визначення контрольно-фінансових правовідносин та досліджено їх взаємозв’язок з регулятивними та охоронними, що дозволило поглибити розуміння їх особливостей та значення. Охарактеризовано загальні та специфічні ознаки контрольно-фінансових правовідносин, які відрізняють їх від суміжних відносин. Систематизовано основні підходи до визначення сучасної системи контрольно-фінансових правовідносин. Доведено значення юридичних фактів як підстав виникнення, зміни та припинення контрольно-фінансових правовідносин.

The stable development of the economy and the financial system is one of the priority directions of the activity of every country. The transition of independent Ukraine to the market economy and the emergence of monetary relations leads to scale up of its financial activities arising from the formation, distribution and usage of centralized and decentralized funds, which necessitates the control of these processes for its legal regulation. The article is devoted to the study of the concept and features of control financial legal relations. For the first time, It was found the definition of financial legal relations and their connetcions with regulatory and security legal relations, which allowed to deepen understanding of their features and significance. It was characterized general and specific features of control financial legal relations that distinguish them from related relationships. It was systemized the main approaches to the definition of a modern system of control financial legal relations. It was proved the value of legal facts as the basis for the emergence, change and termination of control financial legal relations.
