Сучасні підходи до визначення і розширення компетенції Антимонопольного комітету України

Abstract

В статті визначено компетенцію Антимонопольного комітету України як закріплені Конституцією України, законами України та підзаконними нормативними актами повноваження Комітету з приводу вимоги певної поведінки від фізичних та юридичних осіб в сфері економічної конкуренції; з’ясовано існуючі повноваження Комітету; проаналізовано існуючі проекти і програми співпраці з міжнародним організаціями, що сприятимуть розширенню практичної компетенції Комітету. Актуальність дослідження. В сучасних умовах господарювання найважливішим фактором економічного розвитку країни є наявність конкурентного середовища і його стан. Саме тому однією з основних функцій сучасної держави є збереження конкуренції, і, відповідно, попередження, обмеження і запобігання монопольним тенденціям. Відмінність держави від інших економічних суб’єктів полягає в можливостях її впливу на економічні процеси і в її регулюючій функції. Держава формує конкурентну політику, що проводиться з метою забезпечення умов для змагальності фірм, підвищення конкурентоспроможності економічної системи, ефективність якої позначається на добробуті громадян. На сьогоднішній день українські ринки є сильно монополізованими, що певною мірою заважає нормальному функціонуванню економічної системи. При цьому, антимонопольна політика є ключовим регулюючим економічним інструментом, який слугує засобом підтримки з боку держави балансу між конкурентним середовищем і монополією. Основним суб’єктом реалізації антимонопольної політики держави є Антимонопольний комітет України (далі в роботі – Комітет, АМКУ) – орган, головним завданням якого є недопущення та припинення порушень конкурентного законодавства [2]. Досліджуючи теоретичні основи компетенції, повноважень та функцій державних органів загалом та АМКУ зокрема, в своїх працях викладають свої погляди такі вчені, як М. Андріїв [1], О. Пономарьов [6], А. Солонар [13], А. Ткаченко [15] та інші. Одночасно, незважаючи на наявність певних досягнень в процесі обґрунтування теоретичних основ компетенції АМКУ, практичні особливості реалізації останньої з урахуванням сучасного міжнародного досвіду залишаються малодослідженим.

The article defines the competence of the Antimonopoly Committee of Ukraine as the powers of the Committee on the requirement of certain conduct from individuals and legal entities in the field of economic competition, as enshrined in the Constitution of Ukraine, laws of Ukraine and subordinate normative acts; the existing powers of the Committee have been clarified; existing projects and programs of cooperation with international organizations have been analyzed, which will facilitate the expansion of the practical competence of the Committee. Relevance of research. In modern economic conditions, the most important factor in the country's economic development is the presence of a competitive environment and its state. That is why one of the main functions of a modern state is the preservation of competition, and, accordingly, the prevention, restriction and prevention of monopolistic tendencies. The difference between the state and other economic actors lies in the possibilities of its influence on economic processes and its regulatory functions. The state forms a competitive policy, which is conducted in order to provide conditions for the adversarial firms, increase the competitiveness of the economic system, whose effectiveness affects the welfare of citizens. Today, Ukrainian markets are highly monopolized, which to a certain extent interfere with the normal functioning of the economic system. At the same time, antitrust policy is a key regulatory economic tool, which serves as a means of balancing state support between the competitive environment and the monopoly. The Antimonopoly Committee of Ukraine (hereinafter referred to as the Committee, AMCU) is the main subject of the antimonopoly policy implementation of the state - the body whose main task is to prevent and terminate violations of competition law [2]. Examining the theoretical foundations of competence, powers and functions of state bodies in general and AMCU in particular, such scholars as M. Andreev [1], O. Ponomarev [6], A. Solonar [13], A. Tkachenko [ 15] and others. At the same time, despite the presence of certain achievements in the process of substantiation of the theoretical foundations of competence of the Antimonopoly Committee, the practical features of the latter's implementation, taking into account modern international experience, remain poorly researched.
