Abstract У статті визначено поняття прав осіб з інвалідністю. Проаналізовано наукові погляди на поняття «прав» та «свобод», їх розмежування. Аналізуючи погляди науковців запропоновано права та свободи осіб з інвалідністю систематизувати у дві групи загальні та спеціальні. Загальні права передбач-ють конституційні можливості, які однаково стосуються інвалідів та інших членів суспільства (Розділ ІІ Конституції України). У свою чергу, спеціальні права, потребують додаткового забезпечення з боку органів публічної влади. Зазначено, що до спеціальних прав та свобод інвалідів Конвенції ООН про права інвалідів слід віднести: право на рівність і недискримінацію, право на доступність до соціальної та транспортної інфраструктури, право на захист та безпеку у ситуаціях ризику, право на рівність перед законом, право на доступ до правосуддя, право на свободу та особисту недоторканість, право на захист особистої цілісності, право на самостійний спосіб життя й залучення до місцевої спільноти, право на індивідуальну мобільність, право на недоторканність приватного життя, право на повагу до дому та сім’ї, право на освіту, право на найбільш досяжний рівень здоров'я без дискримінації за ознакою інвалідності, право на реабілітацію та медичне забезпечення, право на працю та зайнятість, право на достатній життєвий рівень та соціальний захист, політичні права, право на участь у культурному житті. Розмежовуючи відповідні групи прав наведено ознаки, які притаманні спеціальним правам. Запропоновано права та свободи осіб з інвалідністю об’єднати у три гру-пи: : перша включає особисті права, друга − політичні права, третя − економічні, соціальні та культурні права. Зазначено, що під правами осіб з інвалідністю слід розуміти сукупність всіх прав людини, закріплених в міжнародних та вітчизняних нормативно-правових актах, які потребують додаткового заохочення та забезпечення органами публічної влади без будь-якої дискримінації за ознакою інвалідності.
The article defines the concept of the rights of persons with disabilities. Analyzed the scientific views on the concept of "rights" and "freedoms", their differentiation. Analyzing the views of scientists invited to the rights and freedoms of persons with disabilities in the two groups organize general and special. General rights provide for constitutional opportunities that are equally applicable to persons with disabilities and other members of society (Section II of the Constitution of Ukraine). In turn, special rights require additional support from public authorities. It is noted that the special rights and freedoms of the disabled persons of the UN Convention on the Rights of Persons with Disabilities should be attributed to: the right to equality and non-discrimination, the right to access to social and transport infrastructure, the right to protection and security in situations of risk, the right to equality before the law, the right to access to justice, the right to liberty and security of person, the right to protection of personal integrity, the right to independent living and involvement in the local community, the right to individual mobility, the right to privacy, the right to respect for the home and family, the right to education, the right to the most attainable standard of health without discrimination on the basis of disability, the right to rehabilitation and medical care, the right to work and employment, the right to an adequate standard of living and social protection, political rights, the right to participate in cultural life. The distinction between the respective groups of rights contains features that are inherent in special rights. Proposed to combine the rights and freedoms of persons with disabilities into three groups: the first includes personal rights, the second - political rights, the third - economic, social and cultural rights. Indicated that the rights of persons with disabilities should be understood as the totality of all human rights enshrined in international and domestic normative legal acts, which require additional encouragement and provision by public authorities without any discrimination on the basis of disability.
