Децентралізація влади в Україні: проблема реалізації

Abstract

У статті розглядається сутність поняття децентралізація, аналізуються основні праці із цієї проблематики. Автор робить висновок, що децентралізація як засіб підвищення ефективності функціонування публічної влади вже впродовж тривалого часу перебуває у полі зору науковців та експертів. У роботі порівнюються базові підходи до визначення поняття децентралізації. Приділено увагу поняттям «деконцентрація» та «нецентралізація» та зроблено спробу їхнього розмежування із поняттям «децентралізація». Зроблено висновок, що виходячи із можливих ризиків децентралізація влади на користь органів місцевого самоврядування не може бути абсолютною. Виділені передумови успішної децентралізації. Автор досліджує сутність децентралізації у сучасній Україні посилаючись на нормативноправові акти, які регулюють цей процес. Детально розглядається «Концепція реформування місцевого самоврядування та територіальної організації влади в Україні». У роботі аналізуються основні завдання цієї концепції та ступінь їхньої реалізації. Автором вивчаються переваги та недоліки децентралізації. На підставі проведеного дослідження зроблено висновок, що реформа є частковою, адже реалізованим є лише один з її напрямків – об’єднання територіальних громад. В Україні створені правові основи для реалізації цього напрямку, прийняті відповідні закони, а саме Закони України «Про добровільне об’єднання територіальних громад» та «Про співробітництво територіальних громад», а також розроблено методику формування спроможних територіальних громад. Зроблено висновок, що децентралізація влади в Україні здійснюється через реалізацію концепції реформування місцевого самоврядування та територіальної організації влади. При цьому реформування регіонального рівня місцевого самоврядування не відбувається, як і реформа виконавчої влади

In the article the essence of the concept of decentralization is considered, the main works on this problem are analyzed. The author concludes that decentralization as a method of improving the efficiency of the functioning of public power has been carried out by the scientists and experts for a long time. The paper compares the basic approaches to defining the sence of decentralization. Attention was paid to the concept of "deconcentration" and "noncentralization" and attempted to distinguish it from the notion of "decentralization". It is concluded that on the basis of possible risks decentralization of power in favor of local self-government bodies can not be absolute. The conditions for successful decentralization are highlighted. The author examines the essence of decentralization in modern Ukraine, referring to the legal acts regulating this process. The Concept of the Reform of Local Self-Government and Territorial Organization of Power in Ukraine is being considered in detail. The paper analyzes the main tasks of this concept and the degree of their implementation. The author studies the advantages and disadvantages of decentralization. On the basis of the study, it was concluded that the reform is partial, since only one of its directions - the association of territorial communities - has been implemented. In Ukraine, the legal framework for the implementation of this direction was established, the relevant laws were adopted, namely, the Laws of Ukraine "On voluntary association of territorial communities" and "On cooperation of territorial communities", as well as a methodology for the formation of capable territorial communities. It is concluded that the decentralization of power in Ukraine is carried out through the implementation of the concept of local self-government reforming and territorial organization of power. At the same time, the reform of the regional level of local self-government is not taking place, as the reform of the executive branch
