Система економічної безпеки України: проблеми та перспективи у юридичному вимірі

Abstract

Стаття присвячена аналізу юридичного виміру проблем і перспектив системи економічної безпеки України. При цьому питання юридичного виміру означеної системи становить певний інтерес, оскільки розглядає її організацію й функціонування під правовим кутом зору. Отже, метою цього дослідження є аналіз системи економічної безпеки України у юридичному вимірі її проблем та перспектив. У статті обґрунтовано, що конституційне закріплення терміна «економічна безпека» створило передумову для визначення й утворення системи економічної безпеки, розробки відповідної законодавчої бази, визначення засад правового статусу органів державної влади як суб’єктів забезпечення безпеки означеного типу. З’ясовано, що немає єдиної думку й щодо визначення терміна «економічна безпека» серед науковців, хоча в теорії та на практиці розрізняють різні типи безпеки. Доведено, що через війну в Україні та недостатню наукову розробленість система залишається незбалансованою для того, щоб оперативно реагувати та результативно протидіяти суворим викликам сьогодення. Стаття містить висновок про те, що економічна безпека України є складним і багатогранним явищем, що містить у собі такі види безпеки, як виробнича, енергетична, зовнішньоекономічна, демографічна, продовольча, соціальна, фінансова, інвестиційно-інноваційна та макроекономічна тощо. Наголошується, що й досі не існує легальної дефініції поняття «система економічної безпеки України», хоча наукова спільнота й оперує рядом потужних доктринальних визначень. При цьому визначається, що, вдосконалюючи систему економічної безпеки, варто також звернути увагу на її функції, оскільки вони є необхідним атрибутом будь-якої системи минулого і сучасності, адже визначають напрям діяльності системи економічної безпеки. Крім того, доведено, що система економічної безпеки має змінюватися з часом, оскільки може набувати нових рис і ознак, змінювати пріоритети, цілі та завдання, виконувати функції, що будуть актуальними в конкретній ситуації. Практична цінність роботи полягає в обґрунтуванні необхідності змін уявлення про економічну безпеку як систему та доведенні легального закріплення поняття «система економічної безпеки України».

The article is devoted to the problems of the legal dimension of the problems and prospects of the economic security system of Ukraine. The question of the legal dimension of the specified system is of significant interest, as it considers its organization and functioning from a legal point of view. Therefore, the purpose of this study is to analyze the economic security system of Ukraine in the legal dimension of its problems and prospects. The article substantiates that the constitutional consolidation of the term "economic security" created a prerequisite for the definition and formation of the system of economic security, the development of the appropriate legislative framework, and the determination of the basics of the legal status of state authorities as subjects of security of the specified type. It was found that there is no unified opinion regarding the definition of the term "economic security" among scientists, although in theory and in practice different types of security are distinguished. It has been proven that due to the war in Ukraine and insufficient scientific development, the system remains unbalanced in order to respond promptly and effectively counter the severe challenges of today. The article concludes that the economic security of Ukraine is a complex and multifaceted phenomenon, which includes such types of security as production, energy, foreign economic, demographic, food, social, financial, investment-innovation and macroeconomic, etc. It is emphasized that there is still no legal definition of the concept of "system of economic security of Ukraine", although the scientific community operates with a number of powerful doctrinal definitions. At the same time, it is determined that improving the economic security system should also pay attention to its functions, as they are a necessary attribute of any system of the past and present, because they determine the direction of the economic security system. In addition, it has been proven that the system of economic security must change over time, as it can acquire new features and characteristics, change priorities, goals and tasks, perform functions that will be relevant in a specific situation. The practical value of the work consists in substantiating the need for changes in the perception of economic security as a system and proving the need to legally consolidate the concept of "economic security system of Ukraine".
