Abstract

Актуальність теми дослідження пов’язана зі особливістю соціального значення землі, складністю земельно-правових відносин і значне збільшення числа спорів, пов'язаних із землею. Реформування та вдосконалення земельного законодавства триває з часу проголошення незалежності України, але механізм вирішення земельних спорів, як конфліктів, що можуть ускладнювати діяльність уповноважених органів держави та порушувати права особи на здійснення загального та спеціального землекористування, залишається неврегульованим. Тому виникає нагальна потреба в дослідженні правової доктрини земельних спорів та виокремленні особливостей судової практики їх розгляду та вирішення Верховним Судом та Європейським судом з прав людини. Мета роботи – з’ясування юридичної природи спорів, які пов’язані із земельними правовідносинами, у тому числі дослідження особливостей практики вирішення земельних спорів Верховним Судом та ЄСПЛ. Об’єкт дослідження суспільні відносини, що пов’язані із діяльністю Верховного Суду та ЄСПЛ з розгляду та вирішення спорів, пов’язаних із земельними правовідносинами. Предмет дослідження теоретичні основи, окремі дослідження та погляди вчених-юристів, що охоплюють різні аспекти досліджуваної проблеми, а також матеріали судової практики Верховного Суду та ЄСПЛ, що стосуються розгляду та вирішення спорів, пов’язаних з земельними правовідносинами. Основними результатами роботи стало комплексне дослідження особливостей правової доктрини земельних справ та судової практики які розглянуті та вирішені Верховним Судом та ЄСПЛ.

The relevance of the research topic is related to the peculiarity of the social significance of land, the complexity of land and legal relations, and a significant increase in the number of land-related disputes. Reforming and improving land legislation has been ongoing since Ukraine's independence, but the mechanism for resolving land disputes as conflicts which may complicate the activities of authorized state bodies and violate the rights of individuals to general and special land use remains unregulated. Therefore, there is an urgent need to study the legal doctrine of land disputes and to highlight the specifics of the case law of their consideration and resolution by the Supreme Court and the European Court of Human Rights. The purpose of the study is to clarify the legal nature of disputes related to land relations, including the study of the peculiarities of the practice of land dispute resolution by the Supreme Court and the ECHR. The object of the study is social relations related to the activities of the Supreme Court and the ECHR in considering and resolving disputes related to land relations. The subject of the study is the theoretical foundations, individual studies and views of legal scholars covering various aspects of the problem under study, as well as case law of the Supreme Court and the ECHR relating to the consideration and resolution of disputes related to land relations. The main results of the work are a comprehensive study of the peculiarities of the legal doctrine of land cases and case law considered and resolved by the Supreme Court and the ECHR.
